Capítulo 1
Designação, Localização e Reconhecimento
Artigo 1 Designação da Associação Escutista Nacional
A designação oficial da Associação é: União Nacional dos Escuteiros de Timor-Leste daqui por diante designada pela sigla UNE-TL
Artigo 2 Sede Nacional
A Sede Nacional da UNE-TL está situada em Dili, capital de Timor-Leste.
Artigo 3 Símbolo Oficial
O patrono da associação é o Presidente da República Democrática de Timor-Leste
Artigo 4 Símbolo Oficial
O símbolo oficial da associação é constituído pelos seguintes componentes:
- Estrela de 5 pontas: representa a "Luz da Nação", que guia a UNE-TL;
- Flor-de-Lis de cor branca: representa a paz e o movimento escutista mundial;
- Mapa de Timor-Leste: representa o local onde a UNE-TL está situada;
- Kaibauk, um ornamento em ouro para a cabeça, com a designação “UNE Timor-Leste”: representa a riqueza da UNE-TL;
- Belak dourado redondo: representa a riqueza do património histórico de Timor-Leste.
- Corda branca com nó direito: representa a unidade e fraternidade de todos os Escuteiros, com o coração puro;
Artigo 5 Idioma Oficial
Os idiomas oficiais da UNE-TL são o Português e o Tétum.
Artigo 6 Reconhecimento Oficial
6.1 Governo de Timor-Leste
A UNE-TL é a única organização escutista nacional reconhecida pelo Governo de Timor-Leste.
6.2 Organização Mundial do Movimento Escutista
A UNE-TL é a única organização escutista nacional filiada na Organização Mundial do Movimento Escutista, como membro de pleno direito.
Capítulo II
Definição, Finalidade e Princípios
Artigo 7 Definição
A UNE-TL é um movimento de educação dos jovens, voluntário, não político, não governamental, aberto a todos sem distinção de origem, raça ou credo de acordo com a Finalidade, Princípios e Método do Movimento Escutista.
Artigo 8 Finalidade
A UNE-TL tem por finalidade a educação integral dos jovens, contribuindo para o seu desenvolvimento, ajudando-os a realizarem-se plenamente no que respeita às suas possibilidades físicas, intelectuais, sociais, espirituais e emocionais, como pessoas e cidadãos responsáveis e como membros das comunidades local, nacional e internacional onde se inserem.
Artigo 9 Princípios
Os princípios são as crenças e as leis fundamentais, que devem ser observados ao perseguir a finalidade. Eles representam um código de conduta, que caracteriza todos os membros do Movimento Escutista. O Escutismo baseia-se em três princípios gerais, assim designados:
- Dever para com Deus
- Dever para com a Pátria e para com os Outros
- Dever para consigo mesmo
O primeiro princípio, dever para com Deus, refere-se à adesão de cada indivíduo a princípios espirituais, à sua lealdade para com a religião que os expressa e à sua aceitação das obrigações daí decorrentes.
O segundo princípio, dever para com a Pátria e para com os outros, refere-se à lealdade do indivíduo para com a Pátria em harmonia com a promoção da paz, da compreensão e da cooperação aos níveis local, nacional e internacional; refere-se ainda à participação do indivíduo no desenvolvimento da sociedade com reconhecimento e respeito pela dignidade do próximo e pela integridade da natureza.
O terceiro princípio, dever para consigo mesmo, refere-se à responsabilidade do indivíduo pelo seu próprio desenvolvimento.
Artigo 10 O Método Escutista
O método escutista é definido como “um sistema de auto-educação progressiva, que tem por base:
- a Adesão à Promessa e Lei Escutistas;
- a Educação pela acção;
- a Vida em pequenos grupos (por exemplo, o bando ou a patrulha), envolvendo, com o auxílio e o conselho dos seus dirigentes adultos, a descoberta e aceitação progressiva pelos próprios jovens da responsabilidade e da preparação para a autonomia com vista ao desenvolvimento da personalidade, à aquisição da competências, à auto-estima, ao serviço dos outros e à capacidade quer de cooperar, quer de dirigir.
- Programas de actividades variados, progressivos e atractivos, baseados nos interesses dos jovens participantes, incluindo jogos, técnicas úteis e a realização de serviços à comunidade; estas actividades desenrolar-se-ão, privilegiadamente, ao ar-livre, em contacto com a natureza.
- a Mística e simbologia, que se refere a todos aqueles elementos oas quais é atribuído um significado (símbolos), p. ex., o nome de uma secção (Lobitos, Exploradores, Pioneiros ou Caminheiros e a elementos identificativos como o uniforme, as insígnias, histórias e cerimónias. Todos estes elementos ajudam a criar um ambiente que contém os valores e a proposta educativa do Movimento, tornando-os acessíveis aos jovens de uma forma que as explicações abstractas nunca conseguiriam.
Artigo 11 A Promessa Escutista, a Lei do Escuta e o Lema da UNE-TL
11.1 A Promessa Escutista
Os jovens membros e os Dirigentes Escutistas fazem o compromisso pessoal da Promessa Escutista, que tem a seguinte formulação:
Prometo pela minha honra, fazer todo o possível por:
- Cumprir os meus deveres para com Deus e a Pátria, Timor-Leste;
- Auxiliar os meus semelhantes em todas as circunstâncias; e
- Obedecer à Lei do Escuta.
11.2 A Lei do Escuta
i) A Honra do Escuta inspira confiança
ii) O Escuta é leal
iii) O Escuta é útil e pratica diariamente uma boa acção
iv) O Escuta é amigo de todos e irmão de todos os outros escutas
v) O Escuta é delicado e respeitador
vi) O Escuta protege as plantas e os animais
vii) O Escuta é obediente
viii) O Escuta tem sempre boa disposição de espírito
ix) O Escuta é sóbrio, económico e respeitador do bem alheio
x) O Escuta é puro nos pensamentos, nas palavras e nas acções
11.3 O Lema da UNE-TL

Capítulo III
Membros
Artigo 12 Membros da UNE-TL
12.1 A adesão à UNE-TL é voluntária e está aberta a todos os habitantes da República Democrática de Timor-Leste que adiram à Finalidade e aos Princípios da Associação.
12.2 Os membros da UNE-TL podem ser, nomeadamente:
a) Membros efectivos:
(i) Crianças e jovens, a quem o programa educativo é dirigido, que façam a Promessa Escutista, que paguem a quota de membro e que sejam membros de um agrupamento filiado – Lobitos (entre os 6 e os 10 anos de idade), Exploradores (entre os 11 e os 15 anos de idade), Pioneiros (entre os 16 e os 17 anos de idade) e Caminheiros (entre os 18 e os 25 anos de idade)
(ii) Dirigentes adultos que façam a Promessa Escutista, que paguem a quota de membro e que, enquanto membros de um agrupamento filiado, apliquem o programa educativo ou que estejam encarregados de tarefas de gestão da UNE-TL aos níveis local, regional ou nacional; Estes adultos têm direito de voto nos órgãos deliberativos da UNE-TL;
b) Membros auxiliares (sem direito de voto): indivíduos ou grupos que adiram à Finalidade e aos Princípios da Associação e que paguem a quota anual fixada pela Equipa Executiva Nacional;
c) Membros Honorários (sem direito de voto): membros eminentes da sociedade de Timor- Leste apoiantes da associação, que são nomeados pela Equipa Executiva Nacional depois de aprovados pela Assembleia Escutista Nacional;
d) Membros por inerência de cargos (sem direito de voto): Indivíduos com cargos honorários não executivos ou membros das Equipas Executivas Nacional ou Regionais, em resultado de cargos oficiais que ocupem no governo ou noutra instituição
Artigo 13 Cidadãos Estrangeiros Membros
13.1 Os cidadãos estrangeiros que sejam legalmente reconhecidos como residentes de Timor-Leste podem ser membros efectivos da associação, desde que adiram à Promessa e Lei Escutistas descritas nos artigos 11.1 e 11.2
13.2 Os cidadãos estrangeiros que sejam legalmente reconhecidos como residentes de Timor-Leste e que desejem formar uma unidade escutista ligada à associação escutista do seu país e vestir o seu uniforme escutista nacional, poderão fazê-lo, se obtiverem a aprovação da Equipa Executiva Nacional.
Capítulo IV
Órgãos da UNE-TL
Artigo 14 Assembleia Escutista Nacional
14.1 A Assembleia Escutista Nacional é constituída pelos seguintes elementos:
a) Presidente Honorário da Associação que será também o presidente da mesa da Assembleia;
b) Dois Vice-Presidentes Honorário;
c) Comissário Geral;
d) Comissário Internacional;
e) Tesoureiro;
f) Comissário para os Recursos Adultos;
g) Comissário para o Programa Educativo;
h) o Director Executivo Nacional (que será também o Secretário da Assembleia);
i) Um Assistente Espiritual Nacional;
j) Os Comissários Regionais (um de cada região);
k) Para além do Comissário Regional, cada região será ainda representada por um representante adicional por cada 200 membros efectivos registados;
l) Um representante de cada Agrupamento Escutista activo, eleito pela Assembleia de Agrupamento;
m) Dois representantes (sem direito de voto) dos Membros Honorários da Associação, nomeados pelo Comissário Geral (um dos representantes deverá ser feminino e o outro masculino);
n) Dois representantes (sem direito de voto) dos Membros Auxiliares da Associação, nomeados pelo Comissário Nacional (um dos representantes deverá ser feminino e o outro masculino);
o) Dois representantes dos membros efectivos jovens que não tenham mais de 26 anos de idade;
p) Três Membros cooptados escolhidos pela Equipa Nacional Executiva;
q) O mais alto representante da liderança espiritual em Timor-Leste e o representante do Ministério / Departamento Governamental responsável pela área da Juventude da República Democrática de Timor-Leste
14.2 Funções da Assembleia Escutista Nacional:
As funções da Assembleia Escutista Nacional são:
a) promover o Movimento Escutista no país e a convivência harmoniosa com outras organizações que partilhem a finalidade da UNE-TL;
b) estabelecer as regras que regem a UNE-TL nos seus níveis nacional, regional e local e proceder a alterações a essas regras;
c) tomar decisões relativamente a assuntos relacionados com os Estatutos, o Regulamento Geral da UNE-TL, com a adesão, demissão ou suspensão de membros, etc. e assegurar que as estruturas dos níveis regional e local aderem e cumprem com as disposições dos Estatutos e regulamentos da associação;
d) Elaborar os regulamentos relacionados com assuntos disciplinares e sobre acções contra os membros da UNE-TL;
e) Eleger os membros da Equipa Nacional Executiva, de entre os seus membros;
f) Eleger ou nomear os titulares de cargos no nível nacional da UNE-TL;
g) Discutir e aprovar o orçamento anual do nível nacional da UNE-TL;
h) Nomear os auditores;
i) Ratificar as contas auditadas na reunião anual, que normalmente terá lugar no mês de Janeiro em cada ano;
j) Preencher as vagas que surjam na Assembleia Escutista Nacional;
k) Receber e aprovar os relatórios anuais na reunião annual;
l) Decidir sobre a qualidade de membro de qualquer indivíduo no caso de surgir uma disputa;
m) Elaborar, emendar e altera as regras e regulamentos da UNE-TL.
14.3 Mandato dos membros da Assembleia Escutista Nacional:
a) O mandato dos membros da Assembleia Escutista Nacional tem a duração de três anos.
b) Os membros da Assembleia Escutista Nacional deixarão de o ser nos seguintes casos:
i. se ele/ela for declarado mentalmente incapaz ou condenado num Tribunal por uma ofensa criminal;
ii. se ele/ela se demitir das suas funções através de uma informação por escrito à UNE-TL.
c) Nenhum membro poderá pertencer à Assembleia Escutista Nacional por mais de dois mandatos consecutivos
14.4 Reuniões da Assembleia Escutista Nacional
a) A Assembleia reunirá pelo menos uma vez por ano, convocada pelo Presidente ou pelo Comissário Geral da UNE-TL.
b) A convocatória de todas as reuniões anuais ordinárias da Assembleia Escutista Nacional, contendo o local, a data, a hora e a ordem de trabalhos da reunião, deverá ser enviada por carta registada a todos os membros da Assembleia, com uma antecedência mínima de trinta dias.
c) Pode ser convocada uma reunião extraordinária da Assembleia por solicitação do Presidente ou do Comissário Geral ou a pedido de um mínimo de dois terços dos membros da Assembleia Escutista Nacional, através de uma comunicação por escrito ou pelos meios mais rápidos disponíveis, contendo o local, a data, a hora e a ordem de trabalhos da reunião, com uma antecedência mínima de quinze dias.
14.5 Quorum
a) O quorum de uma reunião da Assembleia Escutista Nacional é constituído por dois terços dos seus membros.
b) Se até meia hora após a hora fixada para o início da reunião náo estiver reunido o quorum, a reunião poderá efectuar-se com um quórum mínimo de um terço dos membros da Assembleia. Nestes casos, não poderá ser tomada qualquer decisão de alteração aos Estatutos da UNE-TL.
Artigo 15 Equipa Nacional Executiva
15.1 A Associação é administrada pela Equipa Nacional Executiva que é constituída pelos seguintes elementos:

15.2 Mandato dos membros da Equipa Nacional Executiva
O mandato dos membros da Equipa Nacional Executiva tem a duração de três anos. Nenhum membro pode servir a Equipa mais de dois mandatos consecutivos.
15.3 Reuniões da Equipa Nacional Executiva
A Equipa Executiva Nacional reúne pelo menos uma vez em cada semestre. A convocatória das reuniões deverá ser feita com uma antecedência minima de três semanas.
15.4 Quorum
O quorum de uma reunião da Equipa Executiva Nacional é constituído por sete dos seus membros.
Artigo 16 Serviços Centrais
Os Serviços Centrais são o escritório central da UNE-TL, localizado em Dili, capital de Timor-Leste e é responsável por todos os actos administrativos e pela implementação das decisões da Equipa Executiva Nacional e/ou do Comissário Geral. Será composta pelo Director Executivo Nacional e quaisquer outros funcionários requeridos pela associação.
Capítulo V
ESTRUTURA REGIONAL
Artigo 17 Regiões
17.1 O território de Timor-Leste deve ser dividido em regiões para uma efectiva operacionalidade da UNE-TL.
17.2 A criação de qualquer região está sujeita a aprovação da Assembleia Escutista Nacional, estando aberta a possibilidade de cada região adoptar um regulamento interno específico, desde que este seja consistente com os Estatutos e Regulamento Geral da UNE-TL.
17.3 Cada região deverá constituir e nomear uma Comissão de Administração, encarregue de salvaguardar, proteger e administrar as suas propriedades e bens. Esta comissão inclui obrigatoriamente um representante do nível nacional. No caso de uma estrutura regional deixar de existir, a Associação Nacional administrará todas as propriedades e bens dessa estrutura regional, até esta ser reconstituída.
Artigo 18 Agrupamentos Escutistas Locais
a) Um Agrupamento Escutista é constituído por uma combinação de pelo menos duas das seguintes secções: Lobitos, Exploradores, Pioneiros, Caminheiros.
b) Independentemente do número de secções, um Agrupamento terá sempre um Conselho de Agrupamento
c) Todos os Agrupamentos têm de estar filiados na respectiva estrutura regional. Os membros de agrupamentos não registados não poderão utilizar o uniforme e os distintivos da associação nem apresentar-se como membros da UNE-TL.
d) No momento da filiação será atribuído ao Agrupamento um número, para efeitos de identificação.
e) Cada Agrupamento Escutista é liderado por um Chefe de Agrupamento que assegura a coordenação entre as secções e a continuidade do programa educativo. Ele/ela poderão ter a ajuda dos restantes dirigentes do agrupamento e ainda do Comité de Agrupamento, que inclui os pais dos escuteiros.

Capítulo VI
Provisões Adicionais
Artigo 18 Opção Religiosa
19.1 A Crença em Deus é um princípio fundamental da UNE-TL e espera-se que todos os seus membros pratiquem diariamente os preceitos da religião em que acreditam, respeitando ao mesmo tempo a fé dos outros.
19.2 Timor-Leste é um país predominantemente Católico e como tal, os Agrupamentos Escutistas devem desenvolver a dimensão espiritual do Escutismo com ênfase na religião Católica com a colaboração da Autoridade Católica Timorense.
19.3 No mesmo espírito do parágrafo anterior, nos casos em que um Agrupamento tenha uma maioria de membros de outra religião que não a Católica, os seus dirigentes poderão adoptar outras observâncias e instruções em colaboração com a Autoridade Religiosa apropriada.
19.4 Quando um Agrupamento for constituído por Escuteiros de várias religiões, deve assegurar-se que cada um deles participa nas cerimónias da sua opção religiosa (a não ser que um serviço ecuménico tenha sido acordado entre todas as partes).
Artigo 20 Isenção Política e Partidária
A UNE-TL não se identifica com qualquer ideologia partidária nem se integra em qualquer partido político ou no poder constituído. Nenhum membro da UNE-TL em uniforme ou em representação da associação pode participar em encontros ou actividades políticas.
Artigo 21 Finanças
21.1 A UNE-TL é uma associação voluntária que depende de apoio externo, de ajudas governamentais, de angariação de fundos junto de empresas e ainda de pagamentos de serviços prestados, quotas e donativos recolhidos junto dos seus membros.
21.2 As receitas anuais da Associação são compostas por:
- Quotas dos membros ou outros associados
- Donativos ou contribuições de parceiros ou filantropos
- Subsídios ou donativos do Governo ou de Empresas Públicas e Privadas
21.3 Os membros da associação não poderão organizar actividades de angariação de fundos através de métodos que encorajem os jovens a práticas relacionadas com o jogo ou contrárias à legislação de Timor-Leste
21.4 As finanças da associação serão regidas por princípios contabilísticos universalmente aceites
21.5 As contas anuais da associação serão obrigatoriamente inspeccionadas e verificadas no final do ano fiscal por uma Comissão de Auditoria composta por três membros da associação ou por auditores externos nomeados pela Assembleia Escutista Nacional
21.6 A Comissão de Auditoria inspecciona os registos contabilísticos e as contas anuais da UNE-TL e certifica a sua correcção num relatório a apresentar à Assembleia Escutista Nacional
21.7 Enquanto estiverem em funções na Comissão de Auditoria, os membros da associação não poderão ser titulares de qualquer outro cargo no nível nacional
Artigo 22 Relações Externas e Política Geral
22.1 A UNE-TL é um movimento autónomo, não dirigido por qualquer Departamento Governamental ou por qualquer das suas instituições
22.2 A UNE-TL poderá manter relações com quaisquer outras organizações Nacionais de carácter não político que partilhem finalidades e objectivos semelhantes em prol da juventude
Artigo 23 Alterações a estes Estatutos
Estes estatutos poderão ser alterados pela Assembleia Escutista Nacional em qualquer das suas reuniões através de uma maioria de dois terços dos votos expressos, sendo de seguida submetida à aprovação do Comité Mundial do Escutismo antes de entrar em vigor. Os Serviços Centrais deverão divulgar o texto das propostas de alteração aos estatutos com uma antecedência mínima de 3 meses (90 dias) em relação à data da reunião da Assembleia Escutista Nacional
Artigo 24 Entrada em vigor
Estes estatutos entrarão em vigor imediatamente após a sua ratificação por pelo menos dois terços dos votos expressos na Assembleia Escutista Nacional e após a aprovação do Comité Mundial do Escutismo


REGULAMENTO GERAL
Capítulo I
ASSEMBLEIA ESCUTISTA NACIONAL
1. Presidente da mesa da Assembleia Escutista Nacional
O Presidente da UNE-TL ou, na sua ausência, um dos Vice-Presidentes, preferencialmente o mais velho, deverá presidir a qualquer reunião da Assembleia. Se, após 30 minutos da hora prevista para o início dos trabalhos, não estiverem presentes nem o Presidente nem os Vice-presidentes da UNE-TL, os membros presentes escolherão de entre eles, uma pessoa para dirigir os trabalhos da Assembleia
2. Procedimentos de Votações
a) Qualquer questão submetida à apreciação da Assembleia deverá ser decidida por uma votação de braço no ar, a não ser que seja requerida uma votação por voto secreto por pelo menos 50% dos membros presentes com direito de voto
b) Qualquer membro da Assembleia que esteja presente terá direito a um voto. Não são permitidas delegações de voto, a não ser que haja alguma disposição em contrário nestes Estatutos. Uma resolução será aprovada se obtiver uma maioria simples dos votos expressos. Em caso de empate, a resolução é reprovada.
3. Ajustamento da reunião
O presidente da mesa da Assembleia pode, com o consentimento dos membros, adiá-la ou suspendê-la por um período limitado de tempo e, se necessário, deslocar a reunião para outro local
4. Nomeação
Nenhum candidato pode ser proposto para eleições, a não ser que o seu consentimento para ser nomeado para o cargo tenha sido dado ao proponente
6. Representantes legais
a) O Comissário Geral, o Tesoureiro e o Director executivo da UNE-TL serão os representantes legais de todo o património mobiliário e imobiliário da Associação
b) Os representantes legais têm o poder de assinar, constituir, adquirir ou alienar todos os instrumentos legais, obrigações, acções, heranças, etc. em nome da Associação e de assegurar a sua custódia
c) Qualquer vaga, por demissão ou morte de algum dos representantes legais, pode ser preenchida pelo presidente da mesa da Assembleia Escutista Nacional, que para o efeito pode nomear qualquer membro da Associação, até à próxima reunião da Assembleia, onde deverá ser preenchida a vaga pelo meios usuais
d) A nomeação ou substituição de representantes legais deverá ser comunicada às autoridades competentes pelo Director Executivo
6. Nomeação de titulares de cargos
a) O Presidente e os Vice-presidentes são eleitos em cada mandato pela Assembleia Escutista Nacional, de entre os membros da UNE-TL
b) O Comissário Geral é eleito em cada mandato pela Assembleia Escutista Nacional, de entre os membros da UNE-TL
c) O Tesoureiro é eleito em cada mandato pela Assembleia Escutista Nacional, de entre os membros da UNE-TL
d) O Comissário Internacional é eleito pela Assembleia Escutista Nacional sendo depois formalmente nomeado pelo Comissário Geral
e) O Comissário para os Recursos Adultos e o Comissário para o Programa Educativo são eleitos pela Assembleia Escutista Nacional com base nas qualificações especificadas neste regulamento sendo depois formalmente nomeados pelo Comissário Geral
f) O Director Executivo é eleito pela Assembleia Escutista Nacional com base nas qualificações especificadas neste regulamento sendo depois formalmente nomeado pelo Comissário Geral
7. Funções dos titulares de cargos
7.1 O Presidente:
a) Preside às reuniões da Assembleia Escutista Nacional
b) Promove o Movimento Escutista no País
7.2 Os Vice-Presidentes:
Os Vice-presidentes cumprirão as tarefas que lhe forem distribuídas pelo Presidente
7.3 O Comissário Geral
a) Preside às reuniões da Equipa Executiva Nacional
b) Nomeia formalmente os titulares de cargos na associação após a sua eleição pela Assembleia Escutista Nacional ou pela Equipa Executiva Nacional, conforme o caso, entregando-lhes a sua carta de nomeação numa cerimónia de tomada de posse
c) Convoca reuniões extraordinárias da Assembleia Escutista Nacional ou da Equipa Executiva Nacional para qualquer assunto urgente, como e quando necessário
d) Aprova e assina as cartas e declarações de nomeações que sejam necessárias
e) É responsável perante a Assembleia Escutista Nacional pelo bem estar e pelo progresso da UNE-TL
f) Actua, em conjugação com a Assembleia Escutista Nacional, em todos os assuntos administrativos, financeiros e de utilização de propriedades e ainda na nomeação ou exoneração dos titulares de cargos
g) Assegura o serviço de pessoas com capacidades desejáveis para o bem-estar e à promoção do Movimento Escutista e nomeia-os(as) Comissários com as funções descritas neste regulamento
h) Delega algumas destas funções nos outros Comissários ou no Director Executivo, da forma que achar mais adequada
i) Decidir sobre questões que lhe sejam apresentadas pelas estruturas regionais
j) Lidar com matérias relativas a distinções e prémios
k) Aprovar e assinar os certificados e os cargos honorários
l) Aprovar as delegações da UNE-TL participantes em eventos internacionais
m) Nomear Comités ou grupos de trabalho, de acordo com as necessidades
7.4 O Comissário Internacional:
a) A função do Comissário Internacional é desenvolver relações com outras Associações Escutistas Nacionais e manter contactos regulares com a Organização Mundial do Movimento Escutista
b) As responsabilidades do Comissário Internacional incluem ainda a promoção de actividades que conduzam a um melhor relacionamento internacional com outros membros do Movimento
c) Emitir uma “Carta Internacional” para todos os membros que viagem para outro país
d) Escolher as delegações da UNE-TL participantes em eventos internacionais
e) O Comissário Internacional é o principal ponto de contacto nas comunicações entre as Associações Escutistas Nacionais e o Bureau Mundial do Escutismo
7.5 O Tesoureiro
O Tesoureiro Nacional é o responsável por todos os assuntos relacionados com as finanças da associação
a) Isto inclui: a preparação de um orçamento anual para a associação; a gestão das contas financeiras, incluindo contas bancárias e investimentos; a produção de contas anuais a submeter a uma auditoria; a apresentação das contas auditadas à Equipa Financeira Nacional e à Assembleia Escutista Nacional para sua aprovação, e; a angariação de fundos
b) Angaria fundos através das quotas anuais dos membros, de donativos de particulares, empresas ou entidades governamentais e através de actividades especiais de angariação de fundos
c) Todos os fundos recebidos devem ser geridos cuidadosamente e depositados em contas bancárias. Serão necessárias as assinaturas de pelo menos duas pessoas para autorizar o dispêndio de fundos pertencentes à associação
d) Submete as contas anuais da associação a uma auditoria da Comissão de Auditoria ou de uma empresa externa
e) Trabalha em conjunto com a Equipa Financeira Nacional no sentido de executar as responsabilidades associadas à gestão financeira da associação
7.6 O Comissário para os Recursos Adultos:
O Comissário para os Recursos Adultos deverá:
a) Planear, implementar e coordenar a nível nacional a gestão dos recursos adultos, isto é, os sistemas de recrutamento, formação e avaliação dos dirigentes da UNE-TL.
b) Estabelecer a Política Nacional de Recursos Adultos, consistente com a Política Mundial dos Recursos Adultos.
c) Assegurar que a Política de Recursos Adultos da UNE-TL reflecte as políticas gerais da associação, particularmente no que diz respeito às questões do programa educativo
d) Recomendar à associação a nomeação de Dirigentes Adultos para as suas variadas funções
e) Fornecer material de apoio ao recrutamento, formação e planeamento dos formadores, comissários e todas as outras funções que os dirigentes possam assumir na associação, através da publicação de manuais, auxiliares de formação ou outros materiais e ainda da comunicação regular com todos eles
f) Planear e fornecer formação para os dirigentes adultos
g) Estudar as técnicas implementadas para o recrutamento, formação e avaliação de adultos dentro e fora do Escutismo, particularmente junto de outras organizações de juventude existentes no país, colaborando com estas quando tal for apropriado
h) Avaliar, numa base contínua, a eficiência dos Adultos no Escutismo, identificando periodicamente os benefícios que deles decorrem para os jovens no nível local
7.7 O Comissário para o Programa Educativo:
As tarefas do Comissário para o Programa Educativo são:
a) Desenvolver a Política Nacional do Programa Educativo, consistente com a Política Mundial do Programa Educativo
b) Planear e coordenar a nível nacional todas as questões relacionadas com o Programa Educativo na UNE-TL
c) Consciencializar os dirigentes de todos os níveis da associação sobre o que é o Programa Educativo e sobre a respectiva importância
d) Avaliar regularmente e desenvolver o Programa Educativo por forma a adaptar-se à evolução das necessidades dos jovens e da sociedade
e) Produzir manuais para os jovens e adultos em todas as secções etárias
f) Assegurar que o programa é aplicado com um nível satisfatório de qualidade em cada unidade local da associação
g) Integrar dimensões especializadas, como a educação ambiental, o desenvolvimento comunitário, escutismo para jovens com necessidades especiais, etc., no Programa educativo da UNE-TL
h) Liderar a Equipa Pedagógica Nacional e assegurar a formação e o desenvolvimento dos seus membros
i) Fortalecer a unidade do Escutismo através do Programa Educativo em cooperação estreita com Comissários Nacionais para o Programa Educativo de Associações Escutistas de outros países e com o Bureau Mundial do Escutismo.
7.8 O Director Executivo:
O Director Executivo é o responsável por todas as funções administrativas da UNE-TL. As responsabilidades específicas das funções administrativas incluem:
a) Assumir o papel de secretário da Assembleia Escutista Nacional e da Equipa Executiva Nacional
b) Organizar a reunião anual ordinária da Assembleia Escutista Nacional da UNE-TL, de acordo com os Estatutos da associação
c) Produzir o relatório anual de actividades a submeter à aprovação da Assembleia Escutista Nacional
d) Preparar, em conjunto com o Presidente ou o Comissário Geral, a agenda e a acta das reuniões da Equipa Executiva Nacional e da Assembleia Escutista Nacional
e) Preparar e manter actualizado um documento de referência sobre as “Políticas, Organização e Regras” da associação
f) Assegurar as relações públicas por forma a melhorar a imagem da UNE-TL e a encorajar o seu crescimento
g) Produzir boletins de informação regular, revistas, relatórios, etc. para os públicos interno e externo
h) Lidar com todas as questões relativas à gestão das propriedades da UNE-TL, incluindo o seguro de todas as suas posses
i) Assegurar a administração diária e o trabalho de secretariado do nível nacional da UNE-TL
j) Delegar algumas das suas responsabilidades noutros membros do pessoal profissional da UNE-TL, da forma que achar mais apropriado
Capítulo II
Equipa Executiva Nacional
1. Funções da Equipa Executiva Nacional
A Equipa Executiva Nacional é responsável por:
a) Actuar em nome da Assembleia Escutista Nacional no período entre as suas reuniões e implementar as suas decisões, recomendações e políticas
b) Promover o Movimento Escutista em todo o território de Timor-Leste através de visitas, correspondência e apoio técnico e pessoal ou quaisquer outras acções que se revelem apropriadas para esse fim
c) Aprovar as contas e o relatório anual a submeter à aprovação da Assembleia Escutista Nacional na sus reunião anual ordinária
d) Nomear equipas nacional responsáveis por quaisquer assuntos específicos, como e quando necessário
e) Preencher qualquer vaga na Equipa Executiva Nacional devida à morte ou demissão de qualquer um dos seus membros através de cooptação até à realização da seguinte reunião ordinária da Assembleia Escutista Nacional
f) Analisar e aprovar as recomendações de qualquer Equipa Nacional
2. Equipas Nacionais
a) Poderão ser formadas as seguintes Equipas Nacionais para apoiar a Equipa Nacional Executiva e a Assembleia Escutista Nacional nas áreas respectivas
(i) Equipa Pedagógica Nacional
(ii) Equipa Nacional de Recursos Adultos
(iii) Equipa Financeira Nacional
(iv) Equipa Nacional de Relações Públicas
(v) Equipa Nacional de Distinções e Prémios
(vi) Equipa Nacional de Regulamentação
(vii) Equipa Nacional de Planeamento
b) Os mandatos das Equipas Nacionais terão a duração de 3 anos, consistente com a Assembleia Escutista Nacional
c) Para além das Equipas acima mencionadas, a Equipa Executiva Nacional poderá criar outras Equipas com uma finalidade específica de curto prazo
3. Nomeação dos membros das Equipas Nacionais
a) O Presidente de cada Equipa Nacional deverá ser nomeado pela Equipa Executiva Nacional após consulta ao respectivo Comissário Nacional
b) Os restantes membros de cada Equipa Nacional deverão ser nomeados pela Equipa Executiva Nacional após consulta ao Presidente da respectiva equipa
c) O Director Executivo Nacional da UNE-TL ou um seu representante serão, por inerência do seu cargo, membros de cada Equipa Nacional com um estatuto equivalente a qualquer outro membro
d) Todas as Equipas Nacionais serão responsáveis pela elaboração de recomendações a submeter à aprovação final da Equipa Executiva Nacional
4. Composição e quorum
Cada equipa nacional deverá ser composta por 7 a 10 membros, sendo o quorum formado por pelo menos quatro deles
5. Organização e funções das Equipas Nacionais
5.1 Equipa Financeira Nacional
A. A Equipa Financeira Nacional é composta pelos seguintes membros:
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) O Tesoureiro
c) O Director Executivo Nacional
d) Pelo menos quatro membros nomeados pela Equipa Executiva Nacional
e) 2 peritos externos (se necessário) nomeados pela Equipa Executiva Nacional
B. Funções da Equipa Financeira Nacional
A Equipa Financeira Nacional terá como funções:
a) Analisar periodicamente questões relacionadas com as finanças e as propriedades da UNE-TL, incluindo encontrar meios para aumentar os seus recursos financeiros
b) Escrutinar e recomendar o orçamento anual da UNE-TL a submeter à aprovação da Equipa Executiva Nacional
c) Rever e recomendar as contas anuais auditadas a submeter à aprovação da Equipa Executiva Nacional
d) Recorrer aos conselhos ou à assistência técnica de qualquer pessoa externa à associação quando tal se revele necessário
e) Através do Tesoureiro, divulgar antes de cada reunião da Assembleia Escutista Nacional, um relatório sobre a situação financeira da Associação
C. Operações Bancárias
Todos os fundos da UNE-TL deverão ser depositados em contas bancárias que, de acordo com as recomendações da Equipa Financeira Nacional, deverão ser movimentadas da seguinte forma:
a) O Comissário Geral, o Tesoureiro e o Director Executivo Nacional serão os três titulares autorizados de qualquer conta bancária em nome da UNE-TL, devendo ser dadas instruções ao Banco para que duas dessas assinaturas sejam suficientes para a movimentação das contas
b) Na ausência de qualquer um dos três titulares autorizados, a Equipa Executiva Nacional poderá nomear titular, qualquer outro indivíduo de entre os seus membros
5.2 Equipa Nacional dos Recursos Adultos
A. A Equipa Nacional dos Recursos Adultos é composta pelos seguintes membros:
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) O Comissário para os Recursos Adultos
c) O Comissário para o Programa Educativo
d) Um membro a nomear por cada estrutura regional, que deverá estar envolvido na Gestão dos Recursos Adultos a nível regional
e) A Equipa Nacional dos Recursos Adultos pode cooptar qualquer membro da Equipa de Formação, obtendo a concordância da estrutura regional
f) O Director Executivo Nacional ou um seu representante como membro por inerência de cargo
B. As funções da Equipa Nacional de Recursos Adultos são:
a) Preparar e corrigir a Política Nacional de Recursos Adultos consistente com a Política Mundial de Recursos Adultos a submeter à aprovação da Assembleia Escutista Nacional
b) Preparar e actualizar um sistema de recrutamento, formação e avaliação de dirigentes para qualquer função por estes desempenhada na UNE-TL
c) Rever periodicamente o progresso da associação em termos de Gestão dos Recursos Adultos e planificar acções para o futuro
5.3 Equipa Pedagógica Nacional
A. A Equipa Pedagógica Nacional é constituída pelos seguintes membros:
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) O Comissário para o Programa Educativo
c) O Comissário para os Recursos Adultos
d) Um membro a nomear por cada estrutura regional, que deverá estar envolvido no desenvolvimento e aplicação do Programa Educativo a nível regional
e) 2 peritos externos (se necessário) nomeados pela Equipa Executiva Nacional
f) Se alguma das secções etárias não estiver representadas, deverá ser nomeado pelo menos um membro especializado nessa secção
g) O Director Executivo Nacional ou um seu representante como membro por inerência de cargo
B. As funções da Equipa Pedagógica Nacional são:
a) Auxiliar o Comissário para o Programa Educativo no desenvolvimento da Política Nacional do Programa Educativo consistente com a Política Mundial do Programa Educativo
b) Rever periodicamente o Programa Educativo da UNE-TL e, se necessário, propor alterações para uma melhor adaptação à evolução das necessidades dos jovens e da sociedade
c) Propor a integração de dimensões especializadas, como a educação ambiental, o desenvolvimento comunitário, escutismo para jovens com necessidades especiais, etc., no Programa educativo da UNE-TL
d) Propor à Equipa Executiva Nacional a nomeação de uma Equipa Nacional especial para lidar com temas específicos, quando tal se revelar necessário
e) Lançar e acompanhar a execução de projectos especiais da Associação baseados nas prioridades nacionais e nas necessidades sociais
f) Aconselhar a Equipa Nacional de Regulamentação na criação de um sistema de insígnias de mérito e competência, de distinções e prémios para os jovens e adultos, a submeter à aprovação da Assembleia Escutista Nacional
5.4 Equipa Nacional de Relações Públicas
A. A Equipa Nacional de Relações Públicas é constituída pelos seguintes membros:
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) O Comissário para as Relações Públicas
c) Um membro representante cada estrutura regional
d) 2 peritos externos (se necessário) nomeados pela Equipa Executiva Nacional
e) O Director Executivo Nacional ou um seu representante como membro por inerência de cargo
B. A Equipa Nacional de Relações Públicas tem como funções:
a) Aconselhar e elaborar recomendações para a Equipa Executiva Nacional em assuntos relacionados com as Relações Públicas e a comunicação
b) Aconselhar e elaborar recomendações para a Equipa Executiva Nacional relativamente ao elacionamento com outras organizações cívicas, educativas, religiosas, sociais, com associações de juventude e infantis
c) Estudar e implementar projectos para construir uma imagem positiva do escutismo na comunidade local e nacional
d) Desenvolver ferramentas de relações públicas para a associação
5.5 Equipa Nacional de Distinções e Prémios
A. A Equipa Nacional de Distinções e Prémios é constituída pelos seguintes membros:
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) Um membro representante cada estrutura regional
c) Os Comissários para o Programa Educativo e para os Recursos Adultos
d) O Director Executivo Nacional ou um seu representante como membro por inerência de cargo
e) 4 outros membros nomeados pela Assembleia Escutista Nacional de entre os seus membros, por recomendação da Equipa Executiva Nacional e do Presidente da UNE-TL
B. A Equipa Nacional de Distinções e Prémios tem como funções:
a) Recolher informação sobre os membros jovens e adultos da associção no que diz respeito ao seu desempenho exemplar em vários campos
b) De acordo com os critérios estabelecidos pela Associação, recomendar à Equipa Executiva Nacional, distinções ou prémios adequados ao reconhecimento público da contribuição dos indivíduos para o Movimento
c) Analisar e recomendar à Equipa executiva Nacional, quando necessário, alterações aos critérios de distinções e prémios através da Equipa Nacional de Regulamentação
5.6 Equipa Nacional de Regulamentação
A. A Equipa Nacional de Regulamentação terá os seguintes membros
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) O Director Executivo Nacional e o seu adjunto como membros por inerência de cargo
c) O Tesoureiro
d) O Comissário Internacional
e) Os Comissários para o Programa Educativo e para os Recursos Adultos
f) Peritos externos (se necessário) nomeados pela Equipa Executiva Nacional, até um máximo de 4 pessoas
B. As funções da Equipa Nacional de Regulamentação são:
a) Rever periodicamente as políticas e regras da associação e submeter à Equipa Executiva Nacional quaisquer alterações que entenda necessárias
5.7 Equipa Nacional de Planeamento
A. A Equipa Nacional de Planeamento
a) O Presidente da Equipa nomeado pela Equipa Executiva Nacional
b) Os Comissários para o Programa Educativo e para os Recursos Adultos
c) Pelo menos 4 membros nomeados pela Equipa Nacional Executiva
d) 2 peritos externos (se necessário) nomeados pela Equipa Executiva Nacional, para assistência técnica
B. As funções da Equipa Nacional de Planeamento são:
a) Consolidar os Planos Regionais e, com base neles, desenvolver um Plano Nacional de Desenvolvimento de longo prazo em consonância com as prioridades e objectivos da UNE-TL
b) Acompanhar e rever periodicamente a implementação do Plano

Capítulo III
Serviços Centrais
1. Os profissionais em funções nos Serviços Centrais são nomeados pela Equipa Executiva Nacional, com base nas recomendções do Director Executivo Nacional
2. As funções dos Serviços Centrais são:
a) Servir a associação na prossecução das suas finalidades e objectivos
b) Assegurar que o Escutismo permanece não militar e não político
c) Assegurar que as estruturas regionais e locais aplicam o Escutismo de acordo com os princípios estabelecidos nos Estatutos da UNE-TL.
d) Formular e assegurar a execução dos Planos de Desenvolvimento da associação, de acordo com as decisões da Assembleia Escutista Nacional e da Equipa Executiva Nacional
e) Publicar literatura escutista
f) Criar e manter um Centro de Documentação onde são preservados todos os documentos necessários e relevantes
g) Analisar as áreas de desenvolvimento do Escutismo no país e, com base nessa análise, apresentar relatórios para a reflexão da Equipa executiva Nacional
h) Coordenar acções com outras agências locais, nacionais ou internacionais que possam contribuir para as finalidades do Movimento Escutista
i) Fazer chegar informação e literatura às estruturas regionais e locais
j)
k) Lidar com todas as questões relacionadas com o Escutismo Mundial

Capítulo IV
Estruturas regionais
1. Filiação
a) Cada região pagará uma quota anual regional e as quotas individuais de cada membro conforme o estabelecido na Assembleia Escutista Nacional e de acordo com a categoria de membro
b) A UNE-TL confirmará a filiação da região através da publicação de um “Certificado” indicando o número de filiação, a data de emissão e a respectiva validade
c) Cada região filiada deverá efectuar um recenseamento dos seus membros no dia 31 de Dezembro de cada ano, cujos resultados deverão ser transmitidos aos Serviços Centrais o mais tardar até 31 de Janeiro do ano seguinte
2. Membros
Os membros das regiões da UNE-TL podem ser, nomeadamente:
a) Membros efectivos: Lobitos, Exploradores, Pioneiros, Caminheiros e Dirigentes adultos que sejam membros de um agrupamento e que paguem a quota de membro;
b) Dirigentes que detenham uma declaração de nomeação válida;
c) Membros auxiliares: indivíduos ou grupos que adiram à Finalidade e aos Princípios da Associação e que paguem uma quota anual fixada pela Equipa Executiva Nacional;
d) Membros Honorários: membros eminentes da sociedade de Timor-Leste apoiantes da associação, que são nomeados pela Equipa Executiva Nacional depois de aprovados pela Assembleia Escutista Nacional;
e) Membros por inerência de cargos: membros das Equipas Regionais, em resultado de cargos oficiais que ocupem no governo ou noutra instituição
f) Patronos, Membros Vitalícios ou quaisquer outros membros que tenham obtido a aprovação da Assembleia Escutista Regional
3. A Assembleia Escutista Regional
A Assembleia Escutista Regional é constituída pelo seguintes elementos:
a) O Presidente
b) Dois Vice-presidentes
c) O Comissário Regional
d) O Comissário Regional Adjunto
e) O Tesoureiro Regional
f) Director Executivo Regional
g) Todos os dirigentes activos na região
h) Um conselheiro jurídico da associação
i) Dois representantes (sem direito de voto) dos Membros Honorários da Associação, intimamente relacionados com a vida da região, nomeados pelo Comissário Regional (um dos representantes deverá ser feminino e o outro masculino);
j) Dois representantes (sem direito de voto) dos Membros Auxiliares da Associação, intimamente relacionados com a vida da região, nomeados pelo Comissário Regional (um dos representantes deverá ser feminino e o outro masculino);
k) Quatro Membros cooptados (sem direito de voto) escolhidos pela Equipa Regional Executiva;
l) O representante regional da liderança espiritual em Timor-Leste e o representante regional do Ministério / Departamento Governamental responsável pela área da Juventude da República Democrática de Timor-Leste
4. Funções da Assembleia Escutista Regional
4.1 A Assembleia Escutista Regional deverá:
a) Actuar em conjunto com o Comissário Regional em prol do desenvolvimento do Escutismo na região e em todas as questões relacionados com as finanças, nomeações e exonerações dos titulares de cargos regionais de acordo com a regulamentação interna
b) Eleger ou nomear os membros da Equipa Regional Executiva e restantes Equipas Regionais
c) Salvaguardar as propriedades e os bens da região
d) Analisar recomendações no sentido da melhoria do Programa Educativo, dos Recursos Adultos, da Gestão Administrativa e Financeira, etc.
e) Nomear os auditores que irão analisar as contas da região
f) Aprovar as contas auditadas, o orçamento e o relatório annual
g) Nomear os delegados à Assembleia Escutista Nacional
h) Formular os regulamentos relacionados com questões disciplinares relativas aos membros da região
4.2 Reuniões da Assembleia Escutista Regional
a) A Assembleia Escutista Regional deverá reunir-se pelo menos uma vez por ano, no local designado pelo Comissário Regional
b) A convocatória da Assembleia Escutista Regional, especificando o local, dia e hora da reunião e ainda a ordem de trabalhos, deverá ser enviada por carta registada a todos os membros da Assembleia, com uma antecedência mínima de 30 dias
c) Assuntos de natureza urgente, determinada pelo Comissário Regional, podem ser apresentados aos membros para sua decisão por correspondência. É necessária uma maioria simples de votos para autorizar os Serviços Regionais a implementar as decisões em nome da Assembleia Escutista regional
d) Podem ser convocadas reuniões extraordinárias, por decisão do Presidente da região ou pelo Comissário regional, com a antecedência de 7 dias, por escrito ou pelos meios mais rápidos de lidar com questões específicas
4.3 Quorum
a) O quorum da Assembleia Escutista Regional é constituído por um terço dos seus membros
b) Se não estiver reunido o quorum até meia hora depois da hora estabelecida para o início da Assembleia, a reunião será adiada por uma hora, após a qual o quorum é constituído por um quinto dos seus membros
4.4 Presidente da Mesa da Assembleia Escutista Regional
O Presidente ou, na sua ausência, o Vice-presidente ou o Comissário Regional dirigirão os trabalhos da Assembleia. Se nenhum destes elementos estiver presente até meia hora depois da hora estabelecida para o início da Assembleia, os trabalhos serão dirigidos pelo Comissário Regional Adjunto ou, na sua ausência por um membro eleito de entre os presentes
4.5 Procedimentos de Votação
a) Qualquer questão submetida à apreciação da Assembleia, deverá ser decidida através de votação de braço no ar, a não ser que seja requerida a votação por voto secreto, por pelo menos 50% dos membros presentes com direito a voto
b) Se os membros da Assembleia Escutista Regional não conseguirem chegar a acordo em relação ao assunto em discussão, este deverá ser colocado à consideração do Comissário Regional, cuja decisão será final
4.6 Adiamento
O Presidente da Mesa da Assembleia pode, com o consentimento dos membros, suspender os trabalhos por um período curto de tempo e, se necessário, deslocar a reunião para outro local
4.7 Nomeações
Nenhum indivíduo poderá ser proposto para uma eleição sem o seu consentimento ter sido obtido pelo proponente
5. Nomeação dos Titulares de Cargos
5.1 O Presidente Honorário
Uma pessoa distinta da região que apoie fortemente o Escutismo será convidada a assumir o cargo de presidente da região
5.2 O Vice-Presidente
Uma pessoa igualmente distinta da região que apoie fortemente o Escutismo será convidada a assumir o cargo de Vice-Presidente da região
5.3 Comissário Regional
a) O Comissário Regional será eleito de entre os membros da Assembleia Escutista Regional. O Comissário Regional terá obrigatoriamente de residir na área geográfica da Região e a duração do seu mandato será de três anos (consistente com o mandato dos membros da Assembleia)
b) Após o anúncio da eleição do Comissário Regional, os Serviços Centrais emitirão um certificado de nomeação assinado pelo Comissário Geral da UNE-TL e pelo Presidente da Região
c) No caso de o cargo de Comissário Regional ficar vago antes do final do seu mandato, o Comissário Regional Adjunto assumirá as funções do Comissário Regional até à eleição do novo Comissário Regional, que ocorrerá numa reunião da Assembleia regional por aquele convocada num período não superior a 60 dias após a data de ocorrência da vaga
5.4 Comissário Regional Adjunto
O Comissário Regional Adjunto será nomeado pelo Comissário Regional para seu apoio directo após consulta à Equipa Executiva Regional
5.5 Tesoureiro Regional
O Tesoureiro Regional será eleito pela Assembleia Escutista Regional, de entre os seus membros e a duração do seu mandato será de três anos. O Tesoureiro poderá ser re-eleito após o final do mandato
5.6 Director Executivo Regional
O Director Executivo Regional será nomeado pela Equipa Executiva Regional, por recomendação do Comissário Regional e ficará responsável, perante a Equipa Executiva Regional e o Comissário Regional, pela administração diária e pelo trabalho de secretariado da região
6. Funções dos Titulares de Cargos
6.1 O Presidente Honorário
O presidente Honorário deverá:
a) Presidir às reuniões da Assembleia Escutista Regional
b) Promover o Movimento Escutista na Região
6.2 Vice-Presidente Honorário
O Vice-Presidente Honorário deverá:
a) na ausência do presidente, presidir às reuniões da Assembleia Escutista Regional
b) Executar as responsabilidades nele delegadas pelo Presidente
6.3 Comissário Regional
a) É responsável, perante a Equipa Executiva Regional e a Assembleia Escutista Regional, pelo bem-estar e pelo progresso do Escutismo na Região
b) Assegura o planeamento e o desenvolvimento do Escutismo na Região, de acordo com as regras e as instruções estabelecidas pelo Comissário Geral
c) É responsável pelo controlo financeiro e pela organização do Movimento em conformidade com os Estatutos da UNE-TL, podendo delegar os seus poderes no Tesoureiro, Comissário Regional Adjunto ou Director Regional Executivo
d) Faz recomendações à Equipa Executiva Regional em relação ao recrutamento ou demissão dos funcionários da UNE-TL na região
e) Promove o Movimento na região e lida com todas as questões daí decorrentes
f) Convoca e preside às reuniões da Assembleia Escutista Regional com o consentimento do Presidente da Região
g) Preside às reuniões da Equipa Executiva Regional
h) Assegura os serviços das pessoas mais capazes para garantirem o bem-estar e a promoção do Movimento Escutista, nomeia-os(as) para o cargo de Comissários Regionais e descreve as funções inerentes a esses cargos
6.4 Comissário Regional Adjunto
a) Assume as responsabilidades nele delegadas pelo Comissário Regional
b) É responsável por uma área geográfica específica da Região, ou
c) É responsável por uma área operacional específica, p.ex. Lobitos, Caminheiros, Escutismo Especial, Formação, etc.
6.5 Tesoureiro Regional
O Tesoureiro Regional deverá
a) ser o titular das contas bancárias da região e o responsável pela contabilização correcta das receitas e despesas por conta dos fundos da Região
b) Se necessário ou se requerido pela Assembleia Escutista Regional, ser o responsável pela Equipa Regional Financeira
c) Aconselhar a Assembleia Escutista Regional e o Comissário Regional em todas as questões relacionadas com as finanças da Região
d) Preparar as estimativas para o orçamento regional anual e apresentá-las à Assembleia Escutista Regional numa reunião convocada para esse efeito
e) Ser o responsável pelas contas anuais da Região, auditadas por um Técnico de Contas
f) Após consulta ao Comissário Regional, investir os recursos financeiros da Região por forma a daí retirar o máximo dividendo
g) Movimentar as contas da região, de acordo com o Regulamento Financeiro da UNE-TL, e
h) Assegurar que todo o desembolso de dinheiro pela região está de acordo com o procedimento estabelecidos pela UNE-TL
6.6 Director Executivo Regional
O Director Executivo regional deverá
a) Assumir as funções de Secretário da assembleia Escutista Regional e da Equipa Executiva Regional
b) Ser o responsável pelo Serviços Regionais
c) Apoiar o Comissário Regional no sentido de garantir um funcionamento correcto do Movimento na Região
d) Ser o responsável pela implementação das decisões da Assembleia Escutista Regional, da Equipa Executiva Regional e restantes Equipas Regionais
e) Lidar com todo o trabalho relacionado com as reuniões, procedimentos e actividades da Assembleia Escutista Regional, da Equipa Executiva Regional e restantes Equipas Regionais
f) ser o responsável por toda a correspondência com os Serviços Centrais, outras Regiões, Departamentos Governamentais, Organizações não-governamentais, Doadores e Comissários (Regionais?)
g) Executar todas as restantes tarefas que lhe sejam consignadas pelo Comissário Regional
h) Ser o responsável pela manutenção dos registos contabilísticos (Livro de Caixa, ????, Diário e Razão, Registo de Stocks da Loja Escutista e Inventário Geral) e será a pessoa que efectua os pagamentos da Região
i) Actuar com um dos representantes legais da Região
j) Preparar o relatório anual da Região
k) Recolher a informação do Recenseamento anual da região e assegura a entrega atempada dessa informação aos Serviços Centrais
7. Equipa Executiva Regional
A Equipa Executiva Regional, responsável por executar as deliberações da Assembleia Escutista Nacional, é composta pelos seguintes membros:
a) O Comissário Regional
b) O Tesoureiro Regional
c) O Director Executivo Regional
d) O Comissário Regional para os Recursos Adultos
e) O Comissário Regional para o Programa Educativo
f) 5 membros eleitos pela Assembleia Escutista Regional de entre os seus membros
g) Um membro da Equipa Regional de Formação
7.2 Funções da Equipa Regional Executiva
a) Tem poderes para criar Equipas Regionais para lidar com qualquer assunto específico, à medida que tal se torne necessário
b) Aprova o relatório anual, as estimativas orçamentais e as contas auditadas a submeter à reunião ordinária da Assembleia Escutista Regional
c) Lida com os assuntos do dia-a-dia da Região
d) Actua, em conjunto com o Comissário Regional, em todos os assuntos relacionados com as Finanças e com o Património
e) Tem poderes para nomear os membros da Região delegados à Assembleia Escutista Nacional, no caso de surgir alguma vaga durante o seu mandato
f) Preencher vagas em cargos da Região, como e quando necessário
7.3 Quorum
O quorum da Equipa Executiva Regional é composto por um terço dos seus membros
7.4 Mandato
O mandato dos membros da Equipa Executiva Regional tem a duração de três anos. Nenhum membro pode estar em funções mais de dois mandates consecutivos.

Capítulo V
Agrupamentos Escutistas Locais
1. Procedimentos de filiação
1.1 Filiação
a) O Dirigente responsável pela formação de cada Agrupamento deverá, logo após a formação do mesmo, enviar ao Director Executivo Regional o formulário de filiação de agrupamento devidamente preenchido em triplicado
b) Os formulários de filiação são apresentados pelo respectivo Chefe de Agrupamento
c) O Director Executivo Regional assegurar-se-á que o Agrupamento é devidamente conduzido por Dirigentes com formação adequada
d) A filiação do Agrupamento será confirmada pelo Comissário Regional após a recomendação do Director Executivo Regional, sendo as cópias do formulário de filiação enviadas ao respectivo Agrupamento, aos Serviços Centrais enquanto que o original é retido nos Serviços Regionais
1.2 Quotas de filiação, renovação de filiação e de membro
A Região deverá encarregar-se da colecta periódica das quotas de filiação e renovação anual de filiação dos Agrupamentos e dos respectivos membros, de acordo com as regras estabelecidas pela Assembleia Escutista Regional
1.3 Suspensão
a) O Comissário Regional poderá suspender um agrupamento se, na sua opinião, as suas actividades estiverem a ser prejudiciais para os interesses do Escutismo
b) A suspensão será considerada uma medida temporária e deverá ser seguida, tão cedo quanto possível, por um inquérito organizado pelo Comissário Regional ou por alguém em seu nome
c) Durante o período da suspensão, todas as actividades do Agrupamento deverão cessar e, a não ser que os termos da suspensão determinem o contrário, todos os Dirigentes e escuteiros ficarão automaticamente suspensos. Nenhum membro do Agrupamento poderá usar o uniforme escutista durante o período da suspensão
d) Como resultado do inquérito a suspensão será levantada se nenhuma acusação for provada. Se as acusações forem provadas, o Agrupamento será extinto e os dirigentes serão exonerados dos seus cargos
1.4 Extinção
O Agrupamento poderá ser extinto pelo Comissário Regional, por recomendação do Director Executivo Regional, tendo este considerado desfavoravelmente o carácter ou a conduta de um Agrupamento ou de um dos seus membros, após a audição desse Agrupamento ou desse membro. O Chefe de Agrupamento em causa ou a autoridade que controla o Agrupamento deverá ter uma oportunidade justa de argumentação junto do Comissário Regional. O Agrupamento ou a pessoa afectada por esta regra, poderá recorrer da decisão junto dos Serviços Centrais
2. Assembleia de Agrupamento
a) Nos casos em que o Agrupamento for formado por duas ou mais secções, os seus Dirigentes reunirão regularmente para discutir todos os assuntos relacionados com a vida do Agrupamento, sendo essa reunião denominada Assembleia de Agrupamento. O Chefe de Agrupamento dirigirá os trabalhos da Assembleia de Agrupamento
b) As funções da Assembleia de Agrupamento são:
• Lidar com a adesão dos membros de todas as secções
• Assegurar o avanço de todos os membros no sistema de progresso
• Melhorar a qualidade da formação dos Dirigentes
• Desenhar os programas de actividades e de formação
• Cooptar o representante dos Guias de Patrulha, como seu membro, se necessário
3. Direcção de Agrupamento
3.1 A Direcção de Agrupamento será o corpo directivo do Agrupamento Escutista, responsável pelo efectivo desenvolvimento e bem-estar geral do Agrupamento. Será composta por:
a) Presidente (a ser nomeado ou eleito pela Direcção do Agrupamento por um período de um ano)
b) Chefe de Agrupamento
c) Chefes de unidade de todas as secções
d) O Secretário de Agrupamento
e) O Tesoureiro de Agrupamento
f) Dois representantes públicos
g) Dois representantes dos pais dos escuteiros recomendados pelo Chefe de Agrupamento
3.2 Funções da Direcção de Agrupamento
As funções do Chefe de Agrupamento são:
a) Ser responsável pela manutenção do património do Agrupamento
b) Lidar com angariação de fundos
c) Assegurar o serviços de pessoas recurso para o Sistema de Progresso
d) Lidar com relações públicas, locais de acampamento e outras instalações necessárias para as actividades do Agrupamento
e) Assegurar a promoção e o efectivo funcionamento do Agrupamento
f) organizar a reunião geral anual
g) Analisar o relatório anual e as contas auditadas, e
h) Avaliar os desenvolvimentos da formação e da aplicação do programa educativo do Agrupamento
3.3 Mandato
O mandato da Direcção de Agrupamento terá a duração de um ano
4. Chefe de Agrupamento
a) O Chefe de Agrupamento é o responsável pela coordenação das actividades de todas as secções em funcionamento no Agrupamento, sempre que este seja composto por mais de uma secção
b) No caso de nenhuma pessoa estar disponível para assumir o cargo de Chefe de Agrupamento, o Comissário Regional poderá nomear um dos Dirigentes do Agrupamento para assumir interinamente o cargo de Chefe de Agrupamento. Nestes casos não será emitida nenhum certificado de nomeação
c) O requerimento do certificado de nomeação de Chefe de Agrupamento será efectuado após a autoridade que controla o Agrupamento nomear um Chefe de Agrupamento adequado e qualificado
d) O Comissário Regional deverá em todos os casos certificar-se que o candidato a Chefe de Agrupamento tem a formação adequada e deverá colocar-se à disposição para fornecer formação adicional
5. Dirigentes de Unidade
a) O adulto por uma unidade de Lobitos, Exploradores, Pioneiros ou Caminheiros será designado Dirigente de Unidade
b) O dirigente de unidade e o(a) seu(sua) agjunto(a) serão nomeados através de um certificado, após recomendação do Chefe de Agrupamento junto do Comissário Regional
c) As seguintes qualificações podem ser requeridas para a nomeação dos Dirigentes de unidade e seus adjuntos:
• Têm de ter participado e obtido qualificação no Curso Básico de Dirigentes de Unidade, na respectiva secção
• Têm de conhecer as Finalidades e os Princípios da UNE-TL, a sua organização e, muito particularmente, o Método Escutista, conforme descritas no documento “Políticas, Organização e Regras”
• Têm de requerer um certificado de nomeação como Dirigentes de Unidade, imediatamente após a sua nomeação, não devendo ter menos de 18 anos
Capítulo VI
Provisões Adicionais
1. Emendas
a) Este Regulamento Geral poderá ser, de tempos a tempos, alterado ou emendado por recomendação da Equipa Executiva Nacional, através de uma resolução de dois terços dos membros da Assembleia Escutista Nacional em reunião convocada com uma antecedência mínima de 30 dias
b) As propostas de alteração a este regulamento deverão circular juntamente com a ordem de trabalhos, que acompanham a convocatória. Nenhuma alteração ou emenda poderá ser aprovada em reuniões convocadas de emergência

Chapter - 1

Name, Domicile and Recognition


Article 1 - The National Scout Association

The official name of the association shall be:

União Nacional dos Escuteiros de Timor-Leste

Article 2 - The Head Office

The Head Office or the National Headquarters of the association shall be located in Dili, the capital city of Timor-Leste.

Article 3 - The Patron

The patron of the association shall be the president of the República Democratíca de Timor-Leste (RDTL)


Article 4 - The Emblem

The emblem of the association consists of:

The Five-Pointed Star, which represents the “Light of the Nation,” that guides the association

The White Fluer-de-liz, represents Peace through the world-wide Scout Movement

The Map of Timor-Leste, represents the place where the association resides.

The Kaibauk, a golden headdress, represents the wealth of the association.

The Belak, a traditional ornament, represents the rich historical background of Timor-Leste.

The White Round Rope and the Reef Knot, represents unity and brotherhood of all Scouts, with a clean heart


Article 5 - Language

The official languages of the association shall be Portuguese and Tetum.





Article 6 - Recognition

6.1 Government of Timor-Leste

The União Nacional dos Escuteiros de Timor-Leste is the only Scout organization recognized by the government of Timor-Leste.

6.2 World Organization of the Scout Movement

The União Nacional dos Escuteiros de Timor-Leste is the only national Scout organization in Timor-Leste, to be affiliated with the World Organization of the Scout Movement, as member.


Chapter - II

Definition, Purpose, and Principles


Article 7 - Definition

The União Nacional dos Escuteiros de Timor-Leste is a voluntary, non-political, non-governmental educational organization for young people open to all without distinction of origin, race or creed in accordance with the Purpose, Principle and Methods of the Scout Movement.

Article 8 - Purpose

The purpose of the association is to contribute to the development of young people in achieving their full physical, intellectual, social, spiritual and emotional potentials as individuals as responsible citizens and as members of their local, national and international community.

Article 9 - Principles

The principles are the fundamental law and beliefs, which must be observed when achieving the purpose. They represent a code of conduct, which characterizes all members of the Movement. Scouting is based upon three broad principles, which represent its fundamental law and beliefs. They are referred as:
· Duty to God and Country
· Duty to the Country and to others
· Duty to self
The first principle, duty to God, refers to a person’s adherence to spiritual principles, loyalty to the religion that expresses them and acceptance of the duties resulting there from.
The second principle, duty to the Country and to others, refers to the loyalty to one’s Country in harmony with the promotion of local, national and international peace, understanding and cooperation; it refers also to a person’s participation in the development of society with recognition and respect for the dignity of one’s fellow-man and for the integrity of the natural world.
The third principle, duty to self, refers to the responsibility for the development of oneself.


Article 10 - The Scout Method

The Scout method is defined as “a system of progressive self-education through:

· Adherence to Promise and Law

· Learning by doing

· Membership of small groups (for example the patrol), involving, under adult guidance, progressive discovery and acceptance of responsibility and training towards self-government directed towards the development of character, and the acquisition of competence, self-reliance, dependability and capacities both to cooperate and to lead.

· Progressive and stimulating programmes of various activities based on the interest of young people including games, useful skills and services to the community, taking place largely in an outdoor setting in contact with nature.

· Symbolic Framework refers to all those elements with a meaning (symbols), e.g. the name of a section (Cub Scout, Scout, Rover), and identification marks, such as the uniform, badges, songs, stories and ceremonies. All these elements help to form a setting, an atmosphere, which bears the values and proposal of the Movement, and makes them more accessible to the young people in a way that abstract explanations could never do.

Article 11 - The Scout Promise, Law and Motto

11.1 The Scout Promise
All youth members and Scout Leaders make the personal commitment of the Scout Promise, with the following formula:
On my honor, I promise that I will do my best
To do my duty to God and my country, Timor-Leste;
To help other people at all times; and
To obey the Scout Law.

11.2 - The Scout Law

A Scout’s honor is to be trusted.

A Scout is loyal.

A Scout is useful and practices every day a Good Deed.

A Scout is a friend to all and a brother to every other Scout.

A Scout is courteous and respectful.

A Scout is a friend to plants and animals.

A Scout is obedient.

A Scout is always in a good mood.

A Scout is thrifty, economic and respects other people’s possessions

A Scout is clean in thought, word and deed.
11.3 - The Scout Motto

Be Prepared (Siempre Alerta para Servir)

Article 12 - Membership of the Association

12.1 The membership of the association is voluntary, open to all those living in Timor-Leste, who adheres to the purpose and principles of the association.


12.2 The following shall be the members of the association, namely:
a) Regular Members
(i) Youth members, for whom the educational programme is provided, who make the Scout Promise, pay the membership fee and are members of a registered Group, - Lobitos (ages 6 to10), Exploradores (ages11 to15), Pioneiros (ages16 to17), Caminheiros (ages18 to 25)
(ii) Adult Leaders, who make the Scout Promise, pay the membership fee and as a member of a registered Group deliver the youth programme, or provide direct management support at national or local levels. These adults have a vote in the policy-making bodies of the Association.
b) Associate members (non-voting) - Individuals or groups who adheres to the purpose and principles of the association, and pays the membership fee, as determined by the National Executive Committee.
c) Honorary members (non-voting) – eminent members of society willing to support the association, who are nominated by the National Executive Committee and approved by the National Scout Assembly.
d) Ex-officio members (non-voting) - Persons holding non-executive honorary ranks or member of Committees of Regional or National levels, as a result of the official position an individual hold in government or otherwise,

Article 13 - Foreign Nationals as Members

13.1 Foreign members should be admitted as Scout members of the association provided such persons subscribes the Scout Promise as mentioned in Article 10.1 and 10.

13.2 Foreign nationals who wish to form their own Scout unit affiliated to the association of the country of their origin, and wear their own national Scout uniform in Timor-Leste may do so with the approval of the National Scout Executive Committee of the Scout Association.


Chapter IV

Organs of the Association


Article 14 - National Scout Assembly

14.1 There shall be a National Scout Assembly consisting of the following:

a) The President of the association who will also be the chairman of the National Scout Assembly
b) Two vice-Presidents
c) The Chief Commissioner
d) The International Commissioner
e) The Treasurer
f) The Adult Resources Commissioner
g) The Youth Programme Commissioner
h) The Chief Scout Executive ( who shall also be the Secretary of the Assembly)
i) A National Spiritual Leader
j) The Regional Commissioners one per region;
k) In addition to the Regional Commissioner, every region shall be represented by one representative for every two hundred registered young and adult member.
l) One representative of each active Scout Group to be elected by the Group Assembly;)
m) Two representatives (non-voting) of the Honorary Members of the association to be nominated by the National Chief Commissioner (one female and one male representative);
n) Two representatives (non-voting) of the Associate Members to be nominated by the National Chief Commissioner (one female and one male representative);
o) Two representatives from among the young members who are not above twenty-six years of age.
p) Three co-opted members selected by the National Executive Committee
q) The highest religious official of the spiritual leader in Timor-Leste and the representative of the government department / ministry dealing with Youth matters of the República Democrática of Timor-Leste.

14.2 Functions of the National Scout Assembly:

The functions of the National Scout Assembly shall be :

a) Promote the Movement in the country and to arrange harmoniously among the regional associations and like cooperation minded organizations for the purpose in consonance with the principles and policies of the association.

b) To lay down the rules of the National Association, its branch associations and make amendments and alterations thereto.

c) To take decisions on matters of Policy, By-laws, Registration Cancellation and Suspension, etc. and to ensure adherence to the provisions of Policy, Organization and Rules by the branch associations.

d) To formulate the regulations relating to the disciplinary proceedings and actions against the members of the association.

e) To elect the members of the National Scout Executive Committee from amongst its members.

f) To elect / appoint office bearers of the National Association.

g) To consider and approve the budget of the National Association.

h) To appoint auditors.

i) To pass audited accounts at its Annual General Meeting which shall be normally held in the month of January every year.

j) To fill the vacancies in the National Scout Assembly from time to time.

k) To receive and approve the Annual Reports at its General Meeting.

l) To determine the membership of any person in case of dispute.

m) To make, amend and alter the Constitution, rules and regulations of the association.

14.3 Terms of the Members of the National Scout Assembly:

a. The term of the members of the National Scout Assembly shall be three years.

b. Member of the Assembly shall cease to be its member, on the following grounds:

i. if he/she is found to be of unsound mind or convicted by Court of Law for any criminal offense.

ii. if he/she resigns from his/her office by notice in writing to the association.

iii. No members shall serve the National Scout Assembly for more than two continuous terms


14.4 Meetings of the National Scout Assembly

a) The Assembly shall meet at least once a year at the place summoned by the President or the Chief Commissioner of the Association.

b) Notice of every ordinary annual meeting of the National Scout Assembly specifying the place, date, time and the Agenda of the meeting shall be sent by registered post to every member of the Assembly at least 30 days before the meeting.

c) An extraordinary meeting may be called when required by the President, Chief Commissioner of the Association or by the request of two-thirds of the members of the National Scout Assembly, 15 days notice in writing or by the quickest means available specifying the place, date, time and the Agenda of the meeting.
14.5 : Quorum

a) Two-thirds of the total membership of the Assembly shall constitute quorum for a meeting of the National Scout Assembly.

b) If within half an hour after the time fixed for the meeting there is no quorum, the meeting may be held. Where upon one-third of the members of the Assembly shall form the quorum. In such meeting, decisions on constitutional matters cannot be taken.

Article 15 : National Scout Executive Committee

15.1 The association is administered by the National Scout Executive Committee which consists of the following:

a. Chief Commissioner

b. Regional Commissioners

c. The Treasurer

d. The National Spiritual Leader

e. The International Commissioner

f. The Adult Resources Commissioner

g. The Youth Programme Commissioner

h. The Chief Scout Executive (Secretary)

15.2 Term

The term for the members of National Scout Executive Committee shall be three years. No member shall serve the Committee more than two continuous terms.

15.3 Meetings of the National Scout Executive Committee

The Committee must meet at least once in 6 months. Minimum 3 week notice is compulsory.

15.4 Quorum

Seven members of the Committee shall form the quorum for its meeting

Article 16 - National Headquarters

The National Headquarters shall be the central secretariat of the Association located in Dili, the Capital of Timor-Leste and shall be responsible for taking administrative actions and implementing the decisions of the National Scout Executive Committee and the Chief Commissioner of the association. It shall comprise of Chief Scout Executive and such staff, which the Scout Association may require.


Chapter V

REGIONAL STRUCTURE

Article 17 - Regional Associations

17.1 The whole country will be divided in regions for effective operations of the association..

17.2 The creation of every regional Scout Association is subject to the approval of the National Scout Assembly and the region shall frame its own by-laws consistent to the Constitution and By-Laws of União Nacional dos Escuteiros de Timor-Leste. .

17.3 To safeguard, protect and administer the properties and assets of a region, the regional assembly concerned shall constitute and appoint a Board of Trustees, which will include one representative from the National Association. In the event that the regional association becomes ineffective, the National Association shall administer the properties and assets of such regional association until the regional association is re-constituted.

Article 18 - Group Organizations

a. A Scout Group consist of a combination of at least two of these units: Lobitos, Exploradores, Pioneiros, Caminheiros.

b. Irrespective of the number of sections, a group shall always have a group council.

c. All groups shall be registered with the respective Region. Member of the unregistered groups shall not be entitled to wear uniform and badges and shall not represent themselves as members of the association.

d. A group shall be allotted a number at the time of registration for the purpose of its identity.

e. Each Scout Group is led by a Group Scout Leader who ensures coordination between the sections and continuity of youth programme. He or she may have the help of unit leaders in the group and of the group committee, which includes parents.


Chapter VI

Miscellaneous Provisions


Article 19 - Religious Policy

19.1 Belief in God is a fundamental principle of the Association and it is expected of every Scout to put into daily practice the precepts of the Religion to which he/she belongs while respecting the faith of others

19.2 Timor-Leste is predominantly Catholic and therefore the Scout Groups should develop the spiritual dimension with an emphasis on Catholic religion in consultation with the Catholic authority.

19.3 In the same spirit as article 19.2, where a Scout Group is composed of a majority of members from one particular religion, the concerned Group/Unit leaders may arrange observance and instructions in consultation with the appropriate religious authority.
19.4 Where a group or unit consists of Scouts of various religions it shall be ensured that each one attends the services of his/her own choice (unless an ecumenical service has been agreed by all parties).

Article 20 - Political Policy

The Scout Association shall not be connected with nor shall it endorse any political body. Members of the association in uniform or any member representing the Movement must not take part in political meetings or activities.

Article 21 - Financial Policy

21.1 The association is a voluntary body and depends on public support, government grants, fund raising from enterprises and dues, donations and subscriptions collected from its members.


21.2 The annual receipts of the Association are:

• The registration fee and membership subscription

• The gifts and contributions from partners and philanthropists

• The subsidies or grants from the Government, Public and Private Enterprises.

21.3 Members of the Association shall not organize fund raising activities through any method that would encourage young people in the practice of gambling or which is contrary to the law of Timor-Leste

21.4 The finances of the association shall be ruled by generally accepted accounting principles.

21.5 The annual accounts of the association need to be inspected and checked at the end of the financial year by an Audit Commission of three persons or external auditors appointed by the National Scout Assembly.

21.6 The audit Commission inspects the financial records and annual accounts of UNE-TL and certifies their correctness in a report to the National Scout Assembly.

21.7 Whilst serving on the Audit Commission, no members can hold any other office at national level

Article 22 - External Relations and General Policy

22.1 The Association is an autonomous body not conducted by any Government Department or any of its institutions.

22.2 The Association shall maintain friendly relations with other National organizations of non-political character having similar aims and objectives for the welfare of the youth.

Article 23 Amendments to this Constitution

This Constitution may be amended by the National Scout Assembly at a meeting by a two-third majority of vote casted and shall then be submitted to the World Scout Committee for approval before coming into effect. The National Headquarters should communicate text of proposed amendments to all National Scout Assembly members at least three months (90 days) in advance from the time of the meeting.


Article 24 Affectivity

This Constitution shall be effective upon ratification by two-thirds votes casted in the National Scout Assembly, and after the approval of the World Scout Committee.









BY-LAWS



Chapter I

NATIONAL SCOUT ASSEMBLY


1. Chairman of a National Scout Assembly meeting

The President of the Association or in his absence one of the Vice-President, preferably senior by age, shall take the chair at every meeting. If neither the President or the Vice-Presidents are present within 30 minutes after the time fixed for a meeting the members present shall select one from among themselves to take the chair.

2. Voting procedure
a) Every question submitted to a meeting shall be normally decided by a show-of –hands unless a secret ballot is demanded by at least 50% of those present and voting;
b) Every member of the Assembly present shall have one vote. Voting by proxy shall not be permitted, except as otherwise provided for in this Constitution. Resolutions shall be taken by a simple majority of the members present and voting. In the event of a tie the motion is defeated.

3. Adjustment of the Meeting

The Chairman of the meeting may, with the consent of the members, adjourn it for a short period and if necessary may shift it to another venue.

4. Nomination

No candidate shall be proposed for election unless the consent of the
candidate to be nominated has been obtained by the proposer.

5. Trustees

a) The Chief Commissioner, The Treasurer and the Chief Scout Executive of the Association shall be the trustees of the movable and the immovable property of the association.

b) The trustees shall have the power to sign, execute, deliver or take in possession all legal instruments, securities, bonds, title deeds, etc. for and on behalf of the Association and ensure their safe custody.

c) In case of vacancy caused by resignation or death of any trustee, the Chairman may appoint any member of the Association until the next National Scout Assembly meeting wherein the vacancy shall be filled.

d) The appointment of the trustees or any change in the office of the trustees as stated above shall be communicated to the authorities concerned by the Chief Scout Executive.

6. Appointment of office bearers

a) The Presidents and Vice-Presidents shall be elected for each term by the National Scout Assembly from amongst the members of the association.

b) The Chief Commissioner shall be elected for each term by the National Scout Assembly from amongst the members of the association.

c) The Treasurer shall be elected by the National Scout Assembly for each term, from amongst the members of the association.

d) The International Commissioner shall be elected by the National Scout Assembly and subsequently formally appointed by the Chief Commissioner

e) The National Adult Resources and Youth Programme Commissioner shall be elected by the National Scout Assembly on the basis on the qualifications laid down in the rules and subsequently formally appointed by the Chief Commissioner.

f) The Chief Scout Executive shall be elected by the National Scout Assembly in accordance with the qualifications laid down in the rules and subsequently formally appointed by the Chief Commissioner.

7. Functions of office bearers

7.1 The President:

a) Preside over the meetings of National Scout Assembly.

b) Promote the Scout Movement in the Country.

7.2 The Vice Presidents:

The Vice Presidents shall perform such duties as may be assigned by the President.

7.3 The Chief Commissioner:

a) Preside over the meetings of the National Scout Executive Committee.

b) Formally appoints the Officers of the Association who have been elected by the National Scout Assembly or the National Scout Executive as the case may be, by presenting them with their warrant of appointment at an appointment ceremony

c) Summon emergent meeting of the National Scout Assembly or the National Scout Executive Committee for any special purpose (s) as and when required.

d) Approve and sign the warrants and letters of various appointments as prescribed.

e) Shall be responsible to the National Scout Assembly for the welfare and progress of the association.

f) Act in conjunction with the National Scout Assembly in all matters including administration, finance property and in the appointment and retirement of the office bearers.

g) Secure the services of persons suitable for the welfare and promotion of Scout Movement in various capacities and appoint them in the ranks of commissioner with their job descriptions as per the rules.

h) Delegate such of this powers to other Commissioners/Chief Scout Executive or so as he may deem fit.

i) Give decisions on matters referred to him by the regional associations.

j) Deal matters relating to awards.
k) Approve and sign the certificates and honorable charges etc.

l) Approve the delegations attending foreign events.

m) Appoint Committees and task forces, as may be required.

7.4 The International Commissioner:

a) The function of the International Commissioner is to develop link with other National Scout Associations and to maintain regular contact with the World Organization of the Scout Movement.

b) The responsibilities of the International Commissioner also includes promoting activities that lead to a great international understanding among other members of the Movement.

c) Issue “Letter of Introduction” to the members of the association traveling outside the country.

d) Select the delegations attending international events.

e) The International Commissioner is the principle point of contact in communications among National Scout Associations and the World Scout Bureau.

7.5 The Treasurer:

The National Treasurer is responsible for all financial affairs of the association:

a) This includes preparing an annual budget for the association; managing the financial accounts; including bank accounts and investments; producing the annual statement of accounts and having these audited; presentation of the audit accounts to the Finance Sub-Committee and National Scout Assembly for adoption, and fund raising.

b) Raise funds through annual subscription by members, donations from individuals, companies or government; and through special fund raising activities.

c) All funds received should be handled carefully and should be deposited in the bank account. The signatures of two persons should be required to authorize the spending of funds belonging to the association.

d) Get the financial accounts of the association audited by an independent person or company annually.

e) To work with the Finance Committee in carrying out responsibilities associated with the finances of the association.

7.6 The Adult Resources Commissioner:

The Adult Resources Commissioner shall:-

a) Plan, implement and co-ordinate at national level the Adult Resources Management i.e. the recruitment, training and appraisal system.

b) Establish National Adult Resources Policy consistent with World Adult Resources Policy.

c) Ensure that the Adult Resources Policy of his association reflects the general policies of the association, particularly in regard to programme matters;

d) Recommend to his association the appointments of Leader of Adults in various functions;

e) Provide support for the Recruitment Training and Decision for future for the Trainers, Commissioners other functions of his association through the supply of handbooks, training aids, and other materials, and through regular communication with them;

g) Plan and provide training to adult leaders;

h) Study the techniques employed in the recruitment, training of adults and appraisal both inside and outside Scouting, particularly in other youth organizations in his country, cooperating with them where appropriate;

i) Evaluate, on a continuing basis, the effectiveness of Adults in Scouting, periodically with regards to the benefit gained by the young people at unit level.

7.7 The Youth Programme Commissioner:

The duties of the Youth Programme Commissioner are to:

a) Develop a Programme Policy consistent with World Programme Policy.

b) Plan and coordinate at national level all aspects of Youth Programme in the national association.

c) Create an awareness, among leaders at all levels of the association, of what the Youth Programme is and of its importance.

d) Evaluate regularly and further develop the Youth Programme to meet the changing needs of young people and their society.

e) Produce handbooks for youth members and adult leaders in all age sectors.

f) Ensure that the programme is delivered at a satisfactory quality level in each local unit of the association.

g) Integrate specialized dimensions, such as environmental education, community involvement, Scouting for young people with special needs etc. into Youth Programme.

h) Provide leadership to the National Programme Committee and responsibility for the training and development of its members.

i) Strengthen the unity in Scouting through Youth Programme by close cooperation with other National Programme Commissioners and with the World Scout Bureau.

7.8 The Chief Scout Executive:

The Chief Scout Executive is responsible for all administrative matters in the association. Specific responsibilities for the administrative functions includes:

a) Serves as Secretary to the National Scout Assembly and to the National Scout Executive Committee

b) Organizing an annual meeting of the National Scout Assembly of the association in accordance with the Constitution of the association.

c) Production of the annual report to the National Scout Assembly.

d) Prepare, in consultation with the President/ Chief Commissioner, agenda’s and minutes of meeting of the National Scout Executive Committee and the National Scout Assembly.

e) Preparing and keeping up to date a reference document on “Policies Organization and Rules” of the association.

f) Public relations with the view to enhance the image of the association and encouraging growth.

g) Producing regular newsletters, magazines, reports, etc. for the internal and external public.

h) All matters related to property and liability insurance.

i) Shall be in-charge of the day-to-day administration and shall be responsible for the secretarial work of the National Association.

j) Delegate some of his responsibilities as he may deem fit to the members of the staff.

Chapter II

NATIONAL SCOUT EXECUTIVE COMMITTEE


1. Functions of the National Scout Executive Committee

The Committee shall:

a) Act on behalf of the National Scout Assembly between its meetings; to give effect to its decisions, recommendations and policies.

b) To promote the Scout Movement throughout Timor-Leste by means of visits, correspondence, technical and personal support or other appropriate actions.

c) Approve the annual accounts and annual report for submission to the Assembly at its Annual General Meeting.

d) Have powers to appoint any sub-committee to deal with any particular matter as and when necessary.

e) In case of a vacancy on account of death or resignation or any other reason, co-opt any member of the Committee till the next General Meeting of the National Scout Assembly.

f) Consider and approve the recommendations of various sub committees.

2. Sub-Committees

a) There may be the following Sub-Committees to assist the National Scout Executive Committee and the National Scout Assembly in the concerned areas:

(i) Youth Programme Sub-Committee

(ii) Adult Resources Sub-Committee
(iii) Finance Sub-Committee

(iv) Public Relations Sub-Committee

(v) Awards Sub-Committee

(vi) Rules Sub-Committee

(vii) Planning Sub-Committee

b) The terms of the Sub-Committees will be 3 years consistent with the National Scout Assembly.

c) In addition to the above other Sub-Committees shall be appointed by the National Scout Executive Committee for the specific purpose and short term.

3. Appointment of members to the sub-committee :
a) The Chairman of each subcommittee shall be appointed by the National Executive Committee in consultation with the Commissioner concerned
b) Other members on each committee shall be appointed by the National Executive Committee on recommendation of the concerned committee chairman.
c) The Chief Scout Executive of the association or his representative shall be an ex officio member on each committee having equivalent status as all other members of the committees.
d) All such committees should be responsible and all recommendations shall be made to the National Scout Executive Committee for the final decision .

4. Membership and Quorum:

There may be 7-10 members in each committee. Minimum of four members present in any Sub-Committee meeting will form the quorum.

5. Organization and functions of sub-committees

5.1 Finance sub-committee

A. The Finance Committee shall consist of the following:

a) Chairman of the committee appointed by the National Executive Committee
b) The Treasurer
c) The Chief Scout Executive

d) At least four members nominated by the National Scout Executive Committee and

e) 2 experts (if necessary) to be nominated by the National Scout Executive Committee.

B. Functions of the finance sub-committee,

The finance sub-committee shall:

a) From time to time, consider matters relating to finance and property of the association, including finding ways and means to enhance its finances.

b) Scrutinize and recommend the annual budget of the association for approval to the National Scout Executive Committee.

c) Review and recommend the audited statement of accounts for approval to the National Scout Executive Committee.

d) Be empowered to co-opt any person who is not member of the association for special assistance and advice.

e) Through the treasurer, place before every meeting of National Scout Assembly, a report on financial status of the association.

C. Operation of Accounts :

All funds shall be kept in scheduled banks under the advice of the Finance Sub Committee and the accounts shall be operated by the office bearers in the following manner:

a) The Chief Commissioner, The Treasurer and the Chief Scout Executive shall be the three verified signatories, however, option shall be given to the bank that any two signatures shall be valid or operation of accounts.

b) In the absence of any one of them by such other persons as may be nominated by the National Scout Executive Committee.

5.2 National Adult Resources Sub-Committee

A. There shall be an Adult Resources Sub-Committee comprising of the following:
a) Chairman of the committee appointed by the National Executive Committee

b) The Adult Resources Commissioner

c) The Programme Commissioner

d) One member to be nominated by each Regional Association who may be involved in Adult Resources Management at regional level.

e) The sub-committee may co-opt any member of the Training Team with the concurrence of the regional association.

f) The Chief Scout Executive or his representatives as an ex-officio member.

B. Function of National Adult Resources sub-committee shall:

a) Prepare and amend the National Adult Resources policy consistent to World Adult Resources policy for the approval of National Scout Assembly.

b) Prepare and update on the recruitment training and appraisal system for all functions in the Association.

c) From time to time review the progress of the association in term of Adult Resources Management and plan for future.





5.3 Youth Programme Sub-Committee

A. The Youth Programme Sub-Committee shall consist of the following:
a) Chairman of the committee appointed by the National Executive Committee
b) The Programme Commissioner
c) The Adult Resources Commissioner
d) One member from the programme committee to be nominated by each Regional Association.
e) The sub-committee may co-opt any 2 members as an expert/resource person in the field.
f) If any of the (age) section is not represented at least 1 member shall be nominated from that section.
g) The Chief Scout Executive or his representative as an ex-officio member.

B. Functions of the Programme Sub-Committee

a) Assist the National Programme Commissioner in developing a National programme Policy consistent with World Programme Policy.

b) Time to time review the Youth Programme of the Association and if necessary suggest changes in accordance to meet the changing needs of the young people and the society.

c) Suggest the integration of specialized dimensions such as environmental education, community involvement, Scouting with handicapped etc. into the Youth programme.

d) Wherever necessary suggest the National Scout Executive Committee to appoint a special committee for specialized subjects.

e) Suggest/monitor special projects to be launched by the association based on National priorities and social needs.

f) Advise special recognition, badges, and awards for young people and adult leaders to the National Scout Assembly through Rules Sub-Committee.

5.4 Public Relations Sub-Committee

A. The Public Relations Sub-Committee shall consist of the following:
a) Chairman of the committee appointed by the National Executive Committee.

b) The Public Relations Commissioner

c) One member nominated by each Regional Association

d) The sub-committee may co-opt any 2 members as experts/resource person on the committee.

e) The Chief Scout Executive or his representative as an ex-officio member.

B. Functions of the PR Sub-Committee

a) To advise and make recommendations to the National Scout Executive Committee on matters of Public Relations and communications value.
b) To advise and make recommendations to the National Scout Executive Committee pertaining to the relationships with civic, educational, religious, social welfare, youth instructions and kindred organizations.
c) To study and carry out the projects to build positive image in the local and national community.
d) To develop PR tools for the association.

5.5 Award Sub-Committee
A. The Award Sub-Committee shall consist of the following:
a) Chairman of the committee appointed by the National Executive Committee.

b) One representative of each region nominated by the regional association.

c) The National Adult Resources and Programme Commissioners.

d) The Chief Scout Executive or his representative.

e) 4 other members nominated by the National Scout Assembly amongst the members on recommendation of National Scout Executive Committee and the Chairman.

B. Functions of the Award Committee. The functions of the Award Committee shall be:

a) To collect information about the young and adult members of the association about their outstanding performance in various fields.

b) As per the criteria of the association recommend to the National Scout Executive Committee suitable awards to recognize the individuals contribution to the movement.

c) Whenever necessary analyze and recommend necessary amendments in the criteria of awards to the National Scout Executive Committee through Rules Committee.

5.6 Rules Sub-Committee
A. The Rules Sub-Committee shall consist of the following:
a) Chairman of the committee appointed by the National Executive Committee.

b) The Chief Scout Executive and Assistant Chief Scout Executive.

c) The Treasurer.

d) The International Commissioner.

e) The National Adult Resources and Programme Commissioner.

f) The Committee has the right to co-opt experts resource persons to a maximum of 4.
B. Functions of the Rules Committee: The Committee shall

a) Time to time review the policies and rules of the association and recommend changes to the National Scout Executive Committee.

5.7 Planning Sub-Committee

A. The Planning Sub-Committee shall consist of the following:
a) Chairman of the committee appointed by the National Executive Committee.

b) The Programme and Adult Resources Commissioner

c) At least four members nominated by the National Scout Executive Committee

d) The Sub-Committee may co-opt any two members for technical assistance.

B. Functions of the Planning Committee

a) Consolidate the District and Regional Plan based on which develop a long term National Plan in consonance with the priorities and targets of the association.

b) Monitor and periodically review the implementation of the plan.


Chapter III

NATIONAL HEADQUARTERS

1. The professional staff in the National Headquarters are appointed by the National Scout Executive committee on the recommendation of the Chief Scout Executive

2. The functions of the National Headquarters shall be:

a) To serve the Association in meeting its aims and purpose
b) To ensure that Scouting remain non-military, non-political.

c) To ensure that the regional associations carry on Scouting according to the principles led down in the constitution of the association.

d) To formulate and ensure the execution of development plans of the association as decided by the National Scout Assembly and National Scout Executive Committee.

e) To publish Scout literature.

f) To maintain documentation centre where all necessary records shall be preserved.

g) Analyze the areas of development of Scouting in the country and report to the National Scout Executive Committee.

h) Co-ordinate with other local, national and international agencies who can contribute to the purpose of the Scout Movement.

i) To circulate the regional associations the information and literature.

j) To co-ordinate the branch office to achieve the National Scout Target.

k) To deal with matters relating to World Scouting.


Chapter IV

REGIONAL ASSOCIATIONS
1. Registration

a) Every regional Scout association shall pay an annual registration and individual membership fee as prescribed by the National Scout Assembly from time to time for every uniformed member of the association in accordance with its membership

b) The National Association shall confirm the registration of the regional association by issuing a “Charter” indicating the registration number, date of issue and validity.

c) Every registered regional association shall collect census of its members as on 31st December every year and communicate the same to the National Headquarters by 31st January at the latest.

2. Membership

The following should be the members of the regional association namely:

a) Regular Members – Lobitos, Exploradores, Pioneiros, Caminheiros and adult leaders (Dirigentes), who are the members of a registered group and pays the membership fee.

b) Scout Leaders who holds valid authorization certificates (warrant).

c) Associate Members – individuals or groups who adheres to the purpose and principles of the association, and pays the membership fee, as determined by the National Scout Excecutive Committe.

d) Honorary Members – imminent members of society willing to support the association, who are nominated by the National Scout Excecutive Committe and approved by the National Scout Assembly.

e) e). Ex-officio Members – members of committees, as a result of the official position an individual hold in government or otherwise

f) Patrons, Life Members or nominated members as may be approved by the Regional Scout Assembly.

3. The Regional Scout Assembly

There shall be a Regional Scout Assembly in each region which may consist of the following namely:

a) The President
b) Two Vice Presidents
c) The Regional commissioner
d) The assistant regional commissioner
e) The treasure
f) Regional Scout executive
g) All the adult leaders active in the region
h) One legal adviser of the Association
i) Two representatives (non-voting) of the Honorary Members of the association closely related to the Region, to be nominated by the Regional Commissioner (one female and one male representative)
j) Two representatives (non-voting) of the Associate Members of the association closely related to the Region, to be nominated by the Regional Commissioner (one female and one male representative)
k) Four Co-opted Members (non-voting) selected by the Regional Executive Committee
l) The regional representatives of spiritual leader and the regional representative of Government of the RDTL dialling with youth matters

4. Functions of the Regional Scout Assembly

4.1 The Regional Scout Assembly shall:

a) Act in conjunction with the Regional Commissioner of the region for the development of Scouting in region and in all matters connected with the financial properties, appointments and retirement of the office bearers in accordance with the rules/service rules.

b) Elect/nominate members to the regional committee and subcommittees.

c) Safeguard the properties and assets of the regional association.

d) Consider recommendations for the improvement related to Programme and Adult Resources, Management, Finance etc.

e) Appoint auditors for the purpose of auditing the accounts of the regional association.

f) Approve audited statement of accounts, budget and annual report.

g) Nominate members to the National Assembly.

h) Formulate the regulations related to the disciplinary proceedings and actions against the members of the regional association.

4.2 Meetings of the Regional Scout Assembly

a) The Regional Scout Assembly shall meet at least once a year at any place as announced by the Regional Commissioner.

b) Notice of every meeting of the Regional Scout Assembly, exclusive of the day for which the meeting is called, specifying therein the place, day and hour of meeting, and the nature of the business to be transacted, shall be sent by registered post to every member of Regional Scout Assembly, at least thirty days prior to the meeting.

c) Matters of urgent nature, determined by the Regional Commissioner, may be referred to the members of Regional Scout Assembly by correspondence for their decision. A simple majority shall be necessary to authorize the Regional Headquarters to implement the decisions on behalf of the Regional Scout Assembly.

d) An extraordinary meeting may be called when required by the President of the region or the Regional commissioner with seven days notice in writing or by the quickest means available to deal with the specific issues.



4.3 Quorum

a) One third of the total membership of the Regional Scout Assembly shall constitute quorum for a meeting.
b) If there is no quorum within half an hour after the time fixed for the meeting, the meeting shall adjourned for one hour and thereafter the meeting shall again be held whereupon 1/5th members will form the quorum.

4.4 Chairman of a meeting

The President, in his absence, the Vice-President or the Regional Commissioner of the Regional Scout Assembly shall take the chair at every meeting. If neither the President nor the Regional Commissioner of the Regional Scout Assembly is present within thirty minutes after the time fixed for such meeting, the Assistant Regional Commissioner shall take the chair, and in the absence of the Assistant Regional Commissioner also, the members present shall elect on from among themselves to take the chair.

4.5 Voting Procedure

a) Every question submitted to a meeting shall be normally decided by a show of hands unless a secret ballot is demanded by at least 50% of those present and voting.

b) If the members of the Regional Scout Assembly are unable to agree in any case, the matter’s shall be referred to the Regional Commissioner whose decision shall be final.

4.6 Adjournment

The Chairman of the meeting may, with the consent of the members, adjourn it for a short periods and if necessary to another venue.

4.7 Nomination

No person shall be proposed for election unless the consent of the person to be nominated has been previously obtained by the proposer.

5. APPOINTMENT OF OFFICE BEARERS

5.1 The Honorary President

A distinguished person from the region who support Scouting shall be invited to accept the office of the President of the Region.

5.2 The Vice President

A similar distinguished person from the regional who support Scouting shall be invited to accept the office of the Vice President of the Region.

5.3 Regional Commissioner

a) There shall be a Regional Commissioner who shall be elected amongst members of the Regional Assembly. The Regional Commissioner shall be a person resident within the area of the Region and shall hold office for a period of three years (term consistent with the Regional Assembly).

b) On receipt of intimation of election of Regional Commissioner, the National Headquarters will issue a warrant signed by the Chief Commissioner of the National Scout Association and the President of the Region.


c) In the event of the office of the Regional Commissioner fall vacant before the expiry of his term, the Assistant Regional Commissioner shall act as Regional Commissioner until the election of the new Regional Commissioner and shall convene the meeting of the Regional Assembly to elect the Regional Commissioner within a period of sixty days from the date of occurrence of the vacancy.

5.4 Assistant Regional Commissioner

Assistant Regional Commissioner shall be appointed by the Regional Commissioner in consultation with the Regional Committee. This appointment shall be made for the assistance of the Regional Commissioner.

5.5. Treasurer

There shall be a Treasurer of the Regional Association elected by the Regional Scout Assembly from amongst the member for a period of three years. He can be re-elected on the expiry of his tenure.

5.6 Regional Scout Executive

There shall be a Regional Scout Executive appointed by the Regional Committee on the recommendation of the Regional Commissioner. He shall be responsible to the Regional Scout Committee and the Regional Commissioner for day to day administration and secretarial work of the Regional Association.

6. FUNCTIONS OF OFFICE BEARERS

6.1 The Honorary President

The Honorary President shall:

a) Preside over the meetings of the Regional Scout Assembly

b) Promote the Scout Movement in the region

6.2 Honorary Vice-President

The Honorary Vice-President shall:

a) In the absence of the President presides the Regional Scout Assembly meetings.

b) Execute the responsibilities delegated to him by the President.

6.3 Regional Commissioner

a) Be responsible to the Regional Executive Committee and Regional Assembly for the welfare and progress of Scouting in the Region.

b) Ensure over all planning and development of the Scouting in the region in accordance with the rules and instructions of the Chief Commissioner.

c) Be responsible for the finance control and organization of the Movement in conformity with the Constitution and may delegate his powers to the Treasurer, Assistant Regional Commissioner or the Regional Scout Executive.

d) Make recommendations to the Regional Executive Committee for appointment and retirement of the employees of the association.

e) Promote the Movement in the region and deal with all matters arising there from.

f) Summon and preside over the meetings of the Regional Scout Assembly with the consent of the President.

g) Chair the meeting of the Regional Executive Committee.

h) Secure the services of persons in various capacities suitable for the welfare and promotion of Scout Movement and appoint them in the ranks of Commissioners with their job descriptions.

6.4 Assistant Regional Commissioner

a) To be responsible for the responsibilities delegated by the Regional Commissioner.

b) To be responsible for general duty in a specific area of the region and or

c) To be responsible for special area e.g. Cub Scouts, Scouts, Senior Scouts, Special Scouting, Training etc.

6.5 Regional Treasurer

The Regional Treasurer shall:

a) Be the custodian of the accounts of the Regional Association and responsible for proper accounting of income and expenditure of the funds of the Regional Association.

b) If required and detailed by the Regional Scout Assembly be the convener of the Finance Committee of the Regional Association.

c) Advise the Regional Scout Assembly and the Regional Commissioner on all financial matters.

d) Prepare yearly budgetary estimates of the Regional Association and present the same to the Regional Scout Assembly in a meeting fixed for this purpose.

e) Be responsible to get the accounts of the Regional Association audited by the Chartered Accountant every year.

f) In consultation with the Regional Commissioner, invest the funds of the regional association so as to derive maximum dividend.

g) Operate accounts of the regional association according to the Financial Rules of the associations and

h) Ensure that all disbursements are made in accordance with the financial procedures as prescribed by the Association.

6.6 Regional Scout Executive

The Regional Scout Executive shall:

a) Act as Secretary of the Regional Scout Assembly and its Executive Committee.

b) Be in charge of the Regional Headquarters.

c) Assist the Regional Commissioner in smooth functioning of the Movement in the region.

d) Be responsible for the implementation of the decisions of the Regional Assembly, the Executive Committee and other Sub-Committees thereof.
e) Deal with the work connected with the meetings, proceedings and activities of the Regional Scout Assembly, Committee and other committees thereof.

f) Be in charge of all correspondence with the National Headquarters, and other Regional associations, Government Departments, Non-Government Organizations, Donors and Commissioners.

g) Perform such other duties as may be assigned to him by the Regional Commissioner.

h) Be responsible for maintaining books of accounts (cash book, ledger, journal and subsidiary books, stock register of Scout shop and general inventory) and shall be drawing and disbursing officer of the Regional Headquarters.

i) Act as one of the Trustees of the Regional Association.

j) Prepare annual report of the Regional Association and

k) Collect annual census of the Regional Association and ensure its timely submission to the National Headquarters.

7. Regional Executive Committee

7.1 There shall be Regional Executive Committee of the Regional Scout Assembly to manage its affairs and shall comprise of the following:

a) The Regional Commissioner

b) The Regional Treasurer

c) The Regional Scout Executive

d) The Regional Adult Resources Commissioner

e) The Regional Youth Programme Commissioner

f) Five members to be elected by the Regional Scout Assembly from amongst its members and

g) One member from the Training Team of the region

7.2 Functions of the Regional Committee

a) Have powers to appoint sub-committees to deal with any particular matter as and when necessary.

b) Approve the annual report, budget estimates, audited statements of accounts for submission to the Regional Scout Assembly at its General Meeting.

c) Transact and deal with day-to-day business of the Regional Scout Assembly.

d) Act in conjunction with the Regional Commissioner in all matters relating to finance and property.

e) Have powers to nominate Regional Scout Assembly members on the National Assembly in case of vacancy for the unexpired period.

f) Fill casual vacancies of the Regional Association as and when required by them.


7.3 Quorum

One third of the members of the regional executive committee shall form the quorum for its meeting.

7.4 Term

The term of the members of regional executive committee shall be three years. No member shall serve for more than two continuous terms.


Chapter V

GROUP ORGANIZATIONS


1. Registration Procedure:

1.1 Registration

a) Application forms duly filled in triplicate, for registration of a group shall be presented by the prospective Scouter in charge to the regional Scout Executive immediately after the group is formed.

b) Registration forms shall be presented by the Group Scout Leader concerned.

c) The Regional Scout Executive shall ensure that the group is properly conducted and that suitable and trained Scouters are available.

d) The registration shall be confirmed by the Regional Scouts Commissioner on the recommendation of the Regional Scout Executive and one copy of the application form shall be sent to the concerned group, national headquarters and one copy shall be retained by the Regional Scout Executive.

1.2 Registration, renewal, membership and subscription fee:

The Regional Scout Association shall charge the registration fee/annual renewal fee/annual membership subscription fee as laid down by the Regional Assembly from time to time.

1.3 Suspension:

a) The Regional Scouts Commissioner may suspend a group if in his opinion its activities are prejudicial to the interest of Scouting.

b) Suspension will be regarded as temporary measure and will be followed as soon as possible by an inquiry by the Regional Scouts Commissioner or by a person authorized by him in his behalf.

c) During suspension all activities of the group shall cease and except otherwise provided by the terms of suspension, all Scout Leaders, Scouts of the group shall stand automatically suspended. No member of the group shall wear uniform or badge during suspension.

d) As a result of inquiry the suspension shall be withdrawn if no charge is proved. If the charges are proved, registration shall be cancelled and warrants of Scout Leaders withdrawn.



1.4 Cancellation:

The group registration may be cancelled by the Regional Scout Commissioner on the recommendation of the Regional Scout Executive having reflected adversely upon the character or suitability of any person or group concerned after providing opportunity of hearing such person or group. The scout leader affected or the controlling authority shall be provided fair opportunity to be heard by the Regional Scout Commissioner. The person or group affected under this rule may refer an appeal to the regional headquarters.

2. Group Assembly

a) Where the group consists of two or more sections, the Scouters of the actions will meet regularly to discuss matters affecting the group and such body may be called the Group Assembly. The Group Scout Leader will be the chairman of the Group Assembly.

b) The functions of a group assembly shall be;

• To deal with the enrollment of members of all sections.

• To ensure the advancement of members in the badge system.

• To improve the standard of training of Scout Leaders.

• To chalk out the programme of activities and training and

• To co-opt Senior Sixer, Senior Patrol Leaders as its member if necessary.

3. Group Committee:

3.1 The group committee shall be the managing body of the Scout Group to ensure effective development and over all welfare of the group. It shall comprise of the following:

a) Chairman (to be nominated or elected by the Group Committee for one year)

b) Group Scout leader

c) Unit leaders of all sections

d) The Group Secretary

e) The Group Treasurer

f) Two Public Representatives

g) Two Representatives of Parents recommended by Group Scout Leader.

3.2 Functions of the Group Committee:

The functions of the Group Committee shall be:

a) To be responsible for maintaining group properties.

b) To deal with fund raising

c) To acquire services of persons useful for Badge system

d) To deal with public relations, camping grounds and other facilities required by the group.

e) To ensure promotion and effective working of the group

f) To hold annual general meeting
g) To consider annual report of the group and audited accounts and

h) To assess training and programme developments of the group.

3.3 Term

The term of the Group Committee shall be one year.

4. Group Scout Leader

a) A group Scout Leader shall be responsible for the co-ordination of the activities of all sections of the group, where the group consists of more than one section.

b) In case no person is available to act as Group Scout Leader, the Regional Scout Commissioner, may appoint one of the Scouter of the group to act as Group Scout Leader in-charge. No appointment letter (warrant) will be issued in such cases.

c) Applications for appointment letters (warrants) for Group Scout Leaders will be made after the controlling authority nominates a suitable qualified Scout Leader.

d) The Regional Scout Commissioner shall in every case, satisfy himself that the applicant is trained and would make himself available for any further training.

5. Unit Leaders

a. The adult in charge of Cub Scout, Scout, Senior Scout Unit will be called Unit Leader.

b. The Unit Leader and his/her Assistant Leader shall be appointed with warrant, on the recommendation of the Group Leader by the Regional Scout Commissioner.

c. The following qualifications may be required for appointment as Unit Leader and Assistant Unit Leader, namely:

· must have attended and qualified introductory Basic Course for Unit Leaders in the respective section

· must have a knowledge of the Purpose and Principles of the Association, its organization and particularly the Scout Method as described in “Policy, Organization and Rules”

· must apply for a appointment letter (warrant) as Unit Leader or Assistant Unit Leader immediately after appointment and should not be less than eighteen years of age.

Chapter VI

MISCELLANEOUS

1. Amendments

a) These By-laws may, at any time or time to time be altered or amended on the recommendation of National Scout Executive Committee by a resolution of two-third of the members of the National Scout Assembly, for which thirty days notice should be given to all members of the National Scout Assembly.

b) The proposed amendment in these rules shall be circulated along with the agenda, which shall accompany the notice. No alteration or amendment shall be made at an emergent meeting.
